Given what we already know and his refusal to speak with SIU, why hasn't he been arrested and charged?
He went to a man's house and shot him dead. If I did that, I know where I would be spending Christmas.
You probably would be spending time in the bucket, but your not a LEO engaged in the performance of your duty. At this stage we do not know what happened inside the premises. The officer is not compelled to speak to anybody, you would have the same rights as a civilian.
If he was forced to give a statement "it would not be admissible in court" because a statement must be proven to have been voluntary in every sense of that word. If there are grounds for a charge the officer will be charged, its been done before and will again if the evidence warrants it.
"LEOs performing their duties" outside of their jurisdiction without co-ordination from local authorities???
Something really stinks about this.
I would think that co-operating with SIU is also part of an officers duties. It would be very strange if it is not.
All though the SIU is a civilian organisation - supposedly outside the influence of police force - it appears it does not have enough power.
What is going on here makes the entire Ontario policing stucture look pretty darn shady.
It’s not uncommon for investigations to take officers out of their area. Police in Ontario are officers in all of Ontario. As far as not involving another service members, it usually means their investigation is sensitive in nature, or they have information that the other service members may inadvertently disclose sensitive information, prior to the search. The part I find out of the norm, is that they had an ambulance and crew on the standby.
There’s a lot of questions I’d like to hear the answers to, but more information will no doubt come to light.
We are all curious as to how this will unfold. Will we be told why the warrant needed to be delivered in this manner? It sure seems to me that they wanted him dead for some reason. Why did a crew like this drive over an hour to search a gun repair shop with one 70 year old owner/employee? They left the city, where gang members are shooting each other on a nightly basis. Seems strange to me.
Police officers have the same Charter rights as anyone else. Once you start limiting Charter rights for anyone yours are in jeopardy too. Witness officers however are required to cooperate.

The SIU investigates and then recommends to the Crown whether charges are appropriate. It's not a perfect system but it is preferable to the police investigating the police.
