A gun is considered loaded is the cartridges are in the chamber or in the magazine attached to the gun, that is just basic, go have a read. It is safe to open the gun but the cartridges are still in the chamber and therefore the gun is loaded, so you are technically not in direct control of a loaded firearm, no different than loading it and putting it in your closet.

Now show us where the law allows for charges against a person who breaks open his shotgun and puts it down.

now please show me where this discussion is about someone storing a loaded shotgun in a closet? We are talking about someone in the field hunting.

Once you set it down you are leaving a loaded gun, if you set it down in your home or set it down in the field it does not matter, you need to be in control of that firearm at all times. If you set down your gun and your dog shoots someone then you are negligent, if you set down a gun with the shells in the chamber, on safe or even open the gun is still considered loaded.

Setting down a gun while hunting to deal with a dog or answer natures call for that matter is not abandoning or not being in control of the firearm. Once again this is getting to be a ridiculous thread.

Still waiting for you to answer my question, Fox. Show us in the law where setting down a shotgun, broken open, is an offence.

It is still considered loaded, yes; you could be dinged for crossing a road that way while hunting. But what section of the Criminal Code applies to setting that shotgun down for a moment?

As for whether setting down a shotgun that's been broken open breaks "the law of common sense," perhaps you'd like to explain how that firearm can discharge itself in that state.

Some of the statements made here about some ones' interpretation of some laws they heard about from somewhere as heard by their cousins, uncles, brothers friend who heard from the guy across the street who heard it from his neighbors friend a few years ago, [whew] really makes my head spin! :confused:
