caught someone *update*

I went to check my trail cams again this morning and wanted to talk to the landowner about the guy I had pics of on my trail camera.. as I mentioned, i was not going to accuse anyone or assume anything wrong as he could have had permission to be in there cutting tree's.
on my way out i saw the landowner sitting outside so i sat with him and his family and talked for a while... i advised him a couple weeks back that I noticed truck tracks or some kind of vehicle tracks that went back around the back of the property and into the bush.. i advised him this morning that i had a picture of a guy and his dogs and he seemed surprised. i showed him the pics and stated he had no idea who the guy was and that he had no permission to be back in there.. he stated he (land owner) went back there after i mentioned to him about the tracks and looked around hoping to catch him and to see if the guy was back there cutting his trees or if he was back there planting marijuana or something... i advised him that i didn't see him in person but that his dogs were back there last season chasing deer and he wasn't too impressed.. never said anything badly , just that i saw the tracks , now i got pics of him and he stated " no, nobody else is allowed back there"... so, I am posting pics of the guy again as maybe someone here knows them and can advise him not to be there.. again, i did tread lightly with the land owner and did not once, ever tell him that we don't want him there or that we are going to handle anything in any way or fashion... if we do see him, we will kindly tell them they don't have permission but that is it.. just want to clarify that we very respectfully approached this and advised the landowner .. he made it clear that nobody , other than us, should be back there..

How large an acreage are you hunting here.If its not to large then why not get in there and follow where this ATV went and see what activity was carried out.Was he cutting wood,was he tending a crop of marijuana?

It might also be an idea to get written permission from the owner for yourself and hunting buddies to be on the land which you can show to the trespasser should you come across him.He will probably tell you that your trespassing as a first defense and you can show him your trump card.After asking him who he knows the owner to be by name.I know its hard to confront people you do not know but you will eventually have to do this.

I plan on walking more of the trails when i go in there again next week... i checked my trail cams and did all that before i spoke with the landowner, i was out there pretty early ( before it got too hot) and didn't want to wake them... i am considering getting written permission this way we all ( there are 7 of us in the group spread out over his 3 properties) have a copy on us... i noticed that there is a spot where the main trail forks off, i noticed today that it looks like tracks went down there.. i will go down there and take a closer look next time i am in there.. the land is not posted, but we have signs here that i will bring out next week and see if it is okay with him that we put them out at the points where i can see he is entering/exiting the bush... i don't know honestly what he was doing in there.. originally, i assumed this was a guy that was in cutting wood .. he has leather work gloves, and looks like a shovel or axe in his trailer... i never noticed any sign of tree's being cut so i will have to look into it further next time in... i would say the bush is about 40 acres, so it's not a huge bush but it's decent sized.. i planned ( if i ever saw him) to name the owner of the bush because only we would know that the owner is now the son as his father is in a long term care facility... i am , like i mentioned, going to type of a letter stating we have permission, the names of everyone in the group, all he has to do is sign his name and that should be suffice.. now that i know he has NO right being in there, i am going to make a good point of checking the area good and see if i can find what he would be doing in there.. i find it odd that my landowner has had this farm in his family for over 100 years, and he has run it personally for over 35 years and he has never seen this guy before... all these farmers see each other and talk, so if a long time farmer doesn't know someone it is concerning.. also, this land is not anywhere near public land.. no real spots that i can see that he would come from.. our road is a dirt road but all around us is paved highway... i will have to look closer when i am in there next.. he is in there doing something.. he has to be close too because like i said, last season i had his dogs in there running the bush but never saw him or heard him... so he has to be close, but it's odd the farmer has no clue who he is... weird...

I would talk to the local CO and give him the pic. Let him know what is going on. Around here, you are not required to post bushlots, but it’s the best idea if you can.

Off-Road Vehicles Act, R.S.O. 1990, c. O.4

Officer may stop driver
17 (1) A peace officer may stop any person driving an off-road vehicle. R.S.O. 1990, c. O.4, s. 17 (1).

Land owner may stop driver
(2) The owner or occupier of land may stop any person driving an off-road vehicle on the land. R.S.O. 1990, c. O.4, s. 17 (2).

Duty to stop
(3) Every person who has been signalled to stop by a person authorized to do so under subsection (1) or (2) shall stop forthwith. R.S.O. 1990, c. O.4, s. 17 (3).

Driver to identify himself
(4) Every person stopped under this section or subsection 18 (1) shall, when so requested, identify himself or herself by giving his or her name and address to the person who stopped him or her. R.S.O. 1990, c. O.4, s. 17 (4).

If you got the permission to hunt and also asked for permission to keep a trespasser out I believe you would be covered under the occupier section of this act.Which reads:

occupier” includes,

(a) a person who is in physical possession of the land, or

(b) a person who has responsibility for and control over the condition of land or the activities there carried on, or control over persons allowed to enter the land

In our neck of the woods,trespassing is an automatic ticket,zero tolerance. Info is turned over to OMNRF for follow up if someone is also trespassing to hunt. Trespassing and poaching is a big problem down here.

Could also be designated as an “agent”. Too bad the camera wasn’t set up to get a plate number if one is on the bike...
