Permission and Insurance

One of the landowners sold their property. The new owner came from the city and is a little hesitant to allow hunting on his property. He is worried about the legal ramifications if something goes wrong. He seems like a nice guy, just very nervous about the idea of someone hunting.
I told him I have insurance. He would like to see proof of that. How can I show him proof of insurance. I am a member of OFAH and also a licensed trapper (OFMF).
I hear and read about liability coverage from the two but not sure how I can show/convince the landowner he has nothing to worry about.
Any help/guidance would be appreciated. Would really hate to loose out on this property because I didn't do a good job showing him my insurance proof.
So I guess I am asking, how can I show him proof of coverage. Are their forms I can download.

You can just down load the QR code from OFAH and you're good to go.

So had to recheck my card to be sure and yes on the back of the card issued by OFAH declaring insurance coverage of $5,00,000 and one accidental death and dismemberment of $5,000

Show him your OFAH membership card with a link to their website. All the information can be found there. Good luck.

Trespass and permitted recreational activity

(3) A person who enters premises described in subsection (4) shall be deemed to have willingly assumed all risks and is subject to the duty of care set out in subsection (1),

(a) where the entry is prohibited under the Trespass to Property Act;

(b) where the occupier has posted no notice in respect of entry and has not otherwise expressly permitted entry; or

(c) where the entry is for the purpose of a recreational activity and,

(i) no fee is paid for the entry or activity of the person, other than a benefit or payment received from a government or government agency or a non-profit recreation club or association, and

(ii) the person is not being provided with living accommodation by the occupier. R.S.O. 1990, c. O.2, s. 4 (3).

When you get your OFMF license there's a wallet sized membership card with your information and on the back it has the details about your insurance policy while trapping, fur harvesting and nuisance animal control activities.

So I guess for clarification purposes ................ is that 5,000,000 liability insurance in place to keep the landowner from being liable while hunting on his place.

I may be off base here but I am pretty sure from past threads that one member being an "insurance guy" was in his opinion anyone who might seek a claim or tort would go after the hunters home insurance first and that the OFAH insurance would be secondary. The OFAH do now have an insurance policy to kick in first but only if you had no home insurance and if you have home liability it would be additional insurance.

So, I should be asking my home insurance company if I am covered and for how much. Then the OFAH insurance kicks in only after my home insurance is tapped out. (if it ever got to that)

That is my understanding, the landowner would in all probability get sued initially as the incident was on his property.

I am pretty sure we also had an example on here a few years ago where a hunters auto insurance was claimed after he accidently shot somebody and it had been to means to get him to the site of the shooting. Similar to this case but it was in Canada.

Landowner might get sued but his insurance will cover it.

Just offer him 10%. I always say if I get hurt on your property I will give you 10% of the lawsuit and if you get hurt on my propety I will let you keep 10%. :moose:

The property owner is not liable for anything unless he is charging you money.
This is as per the act I posted.
If you accidentally shoot one of his cows, as an example, then your home insurance would come into play or your out of pocket.
The OFAH thing is second fiddle.

Short of burning the whole thing down we should not be too worried.
Insurance scams a plenty.

In order to be held liable in an accident case on your property, the plaintiff has to show you (landowner) were negligent and the root cause for the accident to have occurred. ie: a painter falls through the roof because it was rotted away. But if he falls off the roof you're not liable.

It's important to ensure the painter you hire has their own insurance before he starts the job. I found out by "accident" when a contractor sued a neighbor. The neighbor won,but,still had to cough up some very high legal fees.

I had the same Issue trying to get permission to hunt a farm for geese.
got CCFR which has better insurance and also better wordings,

but did not help with the land owner. at the end he said his neighbours might start complaining and what I would do about that ... lol seems like he just didnt want ppl hunting on his land.

You get that back when you sue the contractor...they'll usually settle out of court to save the business's reputation.

the land occupires act protects the land owner from hunting accidents... I even have a letter from the ofah saying the same thing... the insurance is 2 party ...

Yes, exactly. The landowner should not leave an open well or boards with nails laying around as an example.

Nothing to do with hunting.

Well I got my home owners insurance company to write me up something on their letterhead saying how much liability insurance I have ( 2 million) and in quotes ........Covers Hunting Too.....
Plus I added the 5 million secondary insurance with my trappers license information as well, hopefully that will be enough for him.
I emailed him the info, hopefully I hear good news soon :)

Thanks for the update. In essence, if you have a homeowners policy it covers your hunting activities as well. No need to purchase anything else unless it is free. Wise to check your policy and the dollar limit provided. The 2 million looks pretty good.

Well I met up with the new owner at the farm today, he agreed to let me hunt on his property, couple of small conditions.
I will need to email him and in the email, I have to state that I will need to write, he wont be held liable if something goes wrong and that I will text him before I come out. Hopefully the text thing gets drops once he gets to know me a bit more.
He has a locked gate in place now and says he will give me a key (fingers crossed).
Seems like a nice guy. We talked for about 25 minutes, even wants me to setup some targets so he can shoot my .223 one day. Hopefully this is a start of a new friendship.

Got the key :)
Got the landowner and his son to meet me at the farm to do some target shooting this afternoon. I brought along the .22 and .223. I also brought some explosive targets, they thought it was one of the coolest things they have ever done. The dad is a pretty good shot, the son, not so much :) ...... I told him next time I will bring along the .270.
After we finished shooting, we talked a bit more, just before I left, he handed me the key and said, I have made him very happy. :)
