Possession Limits for Ducks

Hey all I was asked a question the other day about possession limits for ducks and I can't seem to find the answer anywhere so I thought I'd ask you all.

As we all know there is a limit to how many ducks we can have and that limit applies to all the ducks in our freezer as well as in the field. We are also able to gift ducks to anyone as long as we follow the regulations on gifting ducks.

So the question is if you were to gift 18 ducks to your wife can you then have 18 ducks of your own in the same house?

I have been reading regulations most of the day trying to see if this would be ok and can't find one regulation that says 2 people in the same house can't have a limit each. It would seem that as long as a CO could tell whose birds were whose then it would be ok.

This may come across as harsh but it sounds like your trying to cheat the system. LOL gifting birds you shot to your wife to double what you can legally keep. As a licenced hunter stay to you limit. If you wish to gift 1 or 2 birds this may be reasonable dumping limits is abusive. Now as for legality you may want to contact a CO and ask your question directly to them.

You are allowed YOUR possession limit.

As per this regulation
12.2 A person may give a migratory game bird to another person for the purpose of mounting or human consumption, or for the purpose of training dogs as retrievers, if the bird was killed under the authority of a migratory game bird hunting permit.

Seems you are limited to A single duck not a possession limit so I think your quest is out of gas

I believe they can be gifted to whoever, but they need to be labelled with the permit number, hunter, etc.

I don't think it is suppose to actually mean only one duck.

How do you read " give a migratory game bird" A bird has always meant 1. Couple meant 2 few meant 3.
It would read
A person may give migratory game birds to another person....
if they really meant more than 1

Its not restricted to one bird, The Migratory Birds Regulations allow legally harvested migratory game birds to be gifted to others and the recipient does not require a Migratory Game Bird Hunting Permit in order to possess such birds legally harvested. There are several requirements for possessing or transporting such gifted birds, however. Birds taken by a hunter that are subsequently possessed by another person must be individually tagged, and have a fully feathered wing attached. For tagging, the hunter must attach a tag to each migratory game bird he gives you, and each tag must contain:

1. the name and address of the hunter and his signature;
2. the Migratory Game Bird Hunting Permit Number under which the birds were taken; and
3. the date the birds were taken.

Also, ensure that you do not exceed the possession limit for that species of migratory game birds which are gifted to you.

As I stated in the original post I was looking for a reg that would state whether more then one person in a house my have a limit of birds. The original example of gifting to your wife was what someone asked me but if that question is offensive to some people lets say it this way.
Two people living in one house both have a licence to hunt ducks go out and shoot ducks, are they both able to have 18 ducks in the freezer?

Please ask yourself why have a possession limit if one could circumvent that requirement by stashing the extra birds so easily.

This is clear as day an attempt to find a loophole, don't be surprised when "they" actually do find some offence to charge you with, even if it's not going to be the number of ducks in your possession. Don't screw with the system or the system will screw you and guess what - it's got a bigger screw. I hope your question was purely hypothetical.
Who needs more than 18 ducks in the freezer..?

1 licensed hunter = 18, 2 licensed hunters = 36. Anyways why would you need to keep 36 birds in your freezer? Time to starting thinking about conservation rather than annihilation of the species if everyone did what you are trying to do how many ducks do you think would be left or any animal for that matter?

Also your wife would have access to your 18 ducks so having any more than 18 would be illegal.

Most of you have missed out on what the original post said let me clear up a few thing.
I was talking with some people about hunting and the topic was raised about can you gift birds to non-hunters? One of the guys wives had asked if it was ok for someone to give her a few birds to cook and since she has no hunting licence there was confusion if this was legal.
So I Looked up the regulations and found that it is legal to gift a non-hunter birds. Question solved.

That is when someone said "If you can gift birds to someone couldn't you gift them all to people and keep hunting?" Once again we looked it up and the law once again confirms you can. I don't condone this behavior.
It would seem some people donate birds to the homeless. I know this is crazy but who wouldn't want to just shoot 18 birds and then spend the rest of the season sitting at home.

That is when one guy still wouldn't agree that gifting birds was legal. He made the point that if you can just gift birds and keep hunting why wouldn't guys just gift them to a family member and keep hunting. This had to be against the law. I thought it must be illegal. So I once again went back to the regulations but couldn't find one that makes this illegal. I thought hey why not ask on the message board, there are lots of knowledgeable people on here one of them might know.

So I am not trying to cheat the system, hide birds, or destroy conservation. I was simply part of a conversation were the question was asked and I didn't know the answer. It bothered me to not be able to find a clear cut regulation on this. I don't feel it is right to do and was hoping to find a law that spells it out.

All you need to do is read the regulations regarding limits. You are allowed a daily limit, that includes any birds you gave away. Your possession limit is just that, any birds in your possession.
Each licenced Hunter is allowed his or her limits, both daily and overall possession. To clarify, I would speak to the MNRF.....

In all fairness to the OP, read the first part of his post. He was asked the question. He is trying to answer that question. At no time did he post that HE was thinking of doing anything wrong.....he is merely asking a question ! Some need to climb down off their soapbox and cut the guy some slack, especially given some of the inaccurate answers.

Please stop posting your ignorance. This was addressed yesterday but let me spell it out for you as you don't seem to be able to comprehend. You may gift " A " migratory bird. Yes. You may shoot 6 in a day. You may gift all 6. Because each bird may be gifted as " A " bird.

As to you stating "You asked a question I posted the regulation." The question was never how many can a person gift as we can all read that regulation, so your answer was never helpful no was it in response to the original question.

As you are asking the question the ignorance is on your part. My interpretation of the regulation and by which I regulate my actions is I may give a bird to a person but if I have 18 in the freezer I'm done. Now if you need a legal interpretation ask A CO or pay a Lawyer. If I become aware of a situation where some one is dumping birds just to go kill some more I would report the action and let the proper authority investigate and determine if its legal or not.

This is the reason why we have daily limits and possession limits. I strongly believe we need to regulate are own actions because yes who wouldn't want too keep shooting when the birds are working the decoys or keep going out once we fill the freezer. Nothing about being on a high horse but showing restraint over self interest. Now if someone can't do it on their own guess we do need big brother to tell us so. Seems the poster is aware of a situation that he feels is not right my advice report it and let the MNR investigate.

as for gifting birds , you can gift as many birds as you would like within your legal daily limit , that being said you can't go out shoot 6 mallards gift them and head back out for another 6 ,
this is prime reason I hunt honkers , no possession limit , fill the freezer and at the end of the season make pepperretes .
And I gift a lot of my wild game each season for less fortinate families in my area , I have gifted and helped clean 60 geese at a time for families because they are struggling and can't afford to it meat , are you going to hold that against me ?

You are good to do that mojo. No one can hold that against you.

So could I gift my possession limit (when I fill it) to a friend but because he doesn't have a freezer I keep them in mine.

The way I see it I am giving back to the community. And as long as I am not breaking the law if someone has an issue with me gifting game they can blow it out there arse .

Not exactly question wasn't so much 4 licensed hunters 4 possession limits which is legal and more power to ya. It was 1 licensed hunter plus 3 non licensed people residents can that licensed hunter keep 72 ducks in the freezer by gifting which is well....

Read it your self. The first scenario was gifting ducks to the wife who doesn't have a license to double the allowable possession.

go back and reread your self as I've written I choose to abide by a more literal interpretation. If others chose an interpretation a little more self serving so be it. As stated my response to some one attempting to increase his possession limit by creative gifting would be a report to the MNR and let them figure it out.

That's the thing with forums its more of a round table for discussion. Wouldn't take any of this as gospel for a definitive answer that would come from the proper authority in writing. In the past have sent emails with questions and although may take some time have gotten response that I go by. Regs are written however one interprets them mostly to suit themselves. They are often formatted to give some flexibility while still with enough teeth to handle abuse.

Is this any different than fish. I can give my wife a limit of fish that I have legally caught and go out and catch another limit (another day) and keep them can't I.

No mojo - but what you are doing is good and fine, but what the OP is asking about is a completely different thing. He's trying to stash a double limit of ducks in his freezer by claiming he's gifted on limit to his wife. I don't think any CO would buy that reasoning.

That's how I'd see it. I'm pretty sure a CO would see it the same way, and the judge will take the CO's interpretation too, I'm pretty sure. It's not like these guys (CO's & judges) are incapable of logical thought.

I've taken the time to read (all) the postings on this thread from beginning to end. ...This has been a good lesson for me on "internet forum dynamics".

Nothing (at all!) wrong with mixed discussion amongst experienced hunters, but when I've been confused about waterfowl regs, and want a definitive answer, sending a detailed-but-concise email to David Critchlow has been my best course of action in regard to getting a clear, solid (and reliable) response.

You can only have the prescribed number of fish in your possession....per licence....so, strictly answering your question....No, if she is unlicensed and lives with you! Unless of course, she ate them all prior to you putting more in your freezer !!

The difference is that you don't need a license to possess fish, only to catch or try to catch them. You still are subject to possession limits though.

Usually questions (even basic ones) to the MNR about migratory birds result in a suggestion you contact environment Canada, who has jurisdiction over this. So I think you're probably right Brent.

possibly however when sunday hunting for waterfowl came into effect sent a query to Dave asking where I intended to hunt if it was good to go. Got a reply saying it was no mention of contacting anyone else.
More recently have a response on carrying lead while waterfowl hunting again his response no other referral

I belong to a club that has had feeding permits since before I can remember. There are clear restrictions like the distance from any hide as well as the size of the sign that is dated and signed and how far out of the water it is. Permit describes the legal location of the property.
No you can not bait even if you live on a body of water and are inclined to feed the ducks at any point...regardless of whether you hunt or not.
I doubt the person in question has a permit to feed.

We are dealing with federal not provincial regulations.

Kinda....sorta...we always fed within yards of a Provincial Park. You must cease feeding 14 days before opening day, and all trace of bait must be gone 7 days before opening day....our pond was checked yearly by local CO's. You are right though, there are regulation to adhere to to have a permitted bait station. Unless of course there have been amendments. But we are off topic !

Might just do it if I had the need to do it however for now as I said if I became aware of someone dumping birds for the sole purpose to go shoot some more easier to report and let them figure it out.

Not sure why they even bother with possession limits. If someone is that worried about it, they can just ditch their birds.

Glad I hunt ducks and geese in farm country natural bait as far as the eye can see, in one place your sometimes worried that the Geese might attack by the thousands. :)

Think thats the point of this discussion. Its not about giving a bird here and there to one who may not have the means but the one who dispenses his allotted bag in order to kill some more which to me is a kin to one who would ditch their birds.

Well based on what you have said, you can only give or gift ONE bird to someone else. But you can throw your whole limit in the ditch.

Not exactly but I'll try to spell it out for you.
For me giving a bird to someone for their benefit its not a problem.
Dispensing with a limit of birds for the selfish reason of killing more is the same as a poacher dumping birds which obviously I'm not okay with.

It still comes down to the fact that a limit of birds can be given to another person. You may not choose to do so.....I understand but there is no regulation prohibiting that.
There are numerous regulations not printed in the summary for example, Retriever Clubs can hold up to 200 legally taken birds each year for the purposes of training/trialing.
Birds can be gifted.

You are right there may not be a rule that's where personal responsibility come in. Sure if it becomes a serious problem they will make a rule and there no doubt be ones saying can't believe all the rule governing our actions.

My understanding is that bag and possession limits are individual. For that reason you are not allowed to party hunt migratory game birds. If you have more than the possession limit of ducks in your freezer. You should probably have them labeled clearly as to who shot them, and the licence number of the shooter. You should as well have the record on each migratory bird licence accurately completed as to dates when birds are shot, and the number taken by each hunter. Birds given away are still part of your bag and comprise part of your daily bag limit, and should they end up in your freezer will be counted against your possession limit. In other words, you cannot give birds away to household family members, even if they are licensed, in order to reduce your own possession limit.
