rumor has it that local police officers will be trained to enforce the fish and wild life act as well as the federal fisheries act . if this is the case why do we have a mnrf enforcement division mind you this is just a rumor.... have you ever heard of this
Municipal/regional and provincial police have been enforcing this for decades.

For every PC to know the intricacies and nuances of environmental law and regs well enough to actively enforce them on a day-to-day basis is exceedingly difficult practically and even logistically,although,some districts are starting to use well acquainted special teams to back up OMNRF CO's and DCO's on special details and investigations. Usually,these teams consist of well-trained,long service senior Marine Enforcement/Snow Patrol/Auxiliary personnel who have taken the extra training on their own initiative and free time. Almost all of them got their interest from being dedicated hunters and anglers,themselves.Quote:

“fishery officer” means a person who is designated as a fishery officer pursuant to subsection 5(1);
5. (1) The Minister may designate any persons or classes of persons as fishery officers or fishery guardians for the purposes of this Act and may limit in any manner the Minister considers appropriate the powers that a fishery officer or fishery guardian may exercise under this Act or any other Act of Parliament.
Above is the section of the Fisheries Act that deals with officers. unlike the FWCA, police are not automatically appointed under the Act. They must be appointed by the Minister from the way I read it. Each officer must be provided with a document certifying that they have been appointed as such. Maybe they all have been....I`m not sure. Any police officers out there have the document?Quote:

Yep,they sure do. It's called a Warrant Card. You may want to read The Police Services Act to find which Acts of Parliament that they enforce. You'll readily see that the duties of Police Constables are all-encompassing with authority under all laws of Canada,no matter which service and/or jurisdiction they work in.Quote:

For sure, but it isn't automatic. I worked joint forces with the RCMP, assigned to them for a few years. When we ran into MBCA issues, I was not authorized to enforce the Act. I wasn't designated by the Minister.Quote:

They are class appointed but don`t believe it came automatically. I think some officers in some jurisdictions may think they are appointed but may not be. I`d check it out before making the 1 M $ unlawful arrest.
They may as well...there's an absolute fortune in fine revenue awaiting them. Governments are seeking revenue sources, and fish fines would be a layup.

They're probably there more for enforcement of the LLA--not that its needed.
i fished quite a bit at frenchmans bay this past summer and the toronto police marine unit routinely check for for license
and they knew a lil bit at least cuz they knew handicapped persons did not need a license
Police as COs on water is a bad idea without some special training which doesn't happen in some cases.
I don't have a link handy but there is at least one case currently before the US courts about a drowning by a suspect who was arrested by a Policeman(Patrol) assigned to additional water duties.
IIRC the Police defended his alleged "negligence" by stating he knew about arrests, suspects, custody and patrol cars but not the same aboard a moving watercraft.
