Wife nuts/ guns gone

Had a push button seperation. Ya 911, he's beating me. Went through the courts. She was found certifiable so guns should come back. Now that being said I would imagine that will take a wee while cause that finding only happened 1 biz day ago. Okay all good,but. Regardless of how that went down a seperation is a seperation and I'm rooked come PAL renewal aren't I ? Face it safe to say she did not loose well so i would think as soon as I tick off seperated on the form, they contact her, she wizzez in my corn flakes the renewal is pooched. That sound right?

It asks questions, probably not a bad idea to move them to your friends place and "give" them to him until your renewal comes in. If she is certifiable as you say and that is noted with the police and the courts then what she says will not cover a lot of weight without evidence. Divorce and separation does not mean you lose your guns, it also does not mean that they will call her. One thin for sure, if you say that you have not been separated trying to keep from her name being on the form you will lose.

Get a lawyer.

From your post, I suspect your guns were seized during the investigation or completion of any hearings. Your PAL would have been suspended as well. You were likely released on conditions not to possess firearms etc., if assault charges were laid etc..
Bottom line, there should have been an order of disposition from the court, for any guns seized. If the court ordered your guns returned, it may take a bit to get them. I'd be calling the investigating officers to expedite the process. Your PAL should be reinstated as well. They won't return any guns until your PAL has been reinstated...With respect to renewing your PAL, answer truthfully, and I would send a letter with the application, explaining your circumstances. And yes, they will be calling your ex.....your renewal will likely take some time as it will be investigated by a firearms officer.
Without knowing exactly what happened, I can only guess what occurred....sound about right ?????

PAL was seized out of wallet by cops. On friday I was given a walk. Free zERO condition, zero bail, zero anything

What about a disposition order for your guns??

Didn't hear of one. Just emailed lawyer to ask

In all the temp seizures including my own in 2001 I've never heard that's needed if innocence was found

Without an order of disposition, weapons are usually forfeited to the crown..talk to your lawyer about this...It will depend on the disposition of the weapons charges...

Howd they come back in 01 w/o order and why is cop shop telling me I only have a month to get them? Get them from the cop lock up if they're gone to crown? Get them from cops if investigating officer says "see if you win trial and get guns"?

No,you're not necessarily "rooked",at all. Police deal with this all the time,so,it's nothing new to them. Depending on what they did with it,you'll need to get your PAL back before you can get your firearms from the Police. The investigating officer should be able to tell you how to proceed.

Nope,that can't happen. Don't waste any time,though. After 90 days,they can be declared as abandoned and then they can be disposed of. Needless to say you and her are definitely done,so,there's no further concern about her having access,right? That could be an issue if she comes back.

I'll tell you though it would be easier if the cops did some before hand investigative work like the USA cops so they didnt always get their a55e5 handed to them cause good lord are they sore about cooperation. Said it was mandatory to take scopes off this time. Its procedure now. I can imagine the job done of the screws on 700 dollar target mounts. I'll take it to civil not with opp on the suit but with the exact officer's name

The problem is that men do shoot their wives and girlfriends and it happens a lot, they cannot take any chances. If you think about it, if your mom accused your dad of abuse and they waited for a week to look into things and your mom was shot in 3 days, how would you feel?

You cannot take chances but at the same time if there is no evidence of wrong doing and you are free and clear on the judges order then you should be fine.

I do suggest when you get them back you find a trusted friend that has no connection to her and who she does not even know to leave your guns with for the time being. If may seem stupid but that friend can always meet you at the range or at your hunting spot with your gun for you use use but if and when she accuses you of unsafe storage, threats to use them against her and all that jazz the cops will show up to your house and find nothing, not a round of ammo and not a single gun. You are the one taking control of the situation here, you are the one who can prove you are doing nothing wrong and her accusations will cause her to look even worse to the courts.

I actually had a hunting buddy who was attacked by his girlfriend, she hit him a pile and so he held her wrists to get her to stop. Once she calmed down he let go and she promptly called her mom, told her he was beating her and started to smash her head into the wall, now who are they going to believe?

No guns in the home, no access to them without your friends supervision and or permission and no chance she can have any legs to stand on.

1. Keep all paperwork. When PAL renewal time comes, if there is an issue, you can have it as back up.

2. Keep in touch with your police detachment who have the guns. Be polite, and courteous. But keep in touch. They will not dispose of them without speaking with you.

3. Ensure you get the disposession of assets resolved shortly. The courts move fairly slow, but once a verdict has been rendered, it should work just fine.

Keep your communication and messaging civil, and forthright ( including on here). Being frustrated is one thing, but having that frustration misconstrued as something else can often happen.

I can tell you that I have been through a divorce and at renewal time they did not even contact my ex....

I figured that they had nothing against me so there was no need to speak to past relationships.

This thread came along at a strange time. I just got a call from a buddy who wants me to pick up his gear this AM and take them to my place. His wife told him last night that she wanted to "explore other possibilities because she thinks it's something she needs to do" after 25 years together. He was completely blindsided and in shock,but,admitted that he's has had a feeling something hasn't been "quite right" for a while. I'm glad to help out. These things can "go south" in a hurry,especially,if the little woman is going through "the change". Better safe than sorry.

In your case. It was property seized as part of a criminal charge, which has had a verdict entered. However the Judge must issue an order to have property returned.

If the police are holding them due to possible issues within the home, they need to show cause why they can retain them. But be very cognizant of the 30 day provision.

Section 490 governs the procedure for detaining property seized under s. 489 or 489.1, including obtaining the approval of justice to detain the property for a period of time.

Contact the Police,tell them you want to pick up your property,including your PAL and ask when to attend the detachment. I can't see them being a**holes about it,but,if they do,be respectful....even if it PO's you to no end. Keep us posted.

The arrogant goof got me off 8 alleged domestics and 4 alleged firearms in front of robert selkirl the most miserable assault/firearms judge in the ottawa valley so I dunno

I thought there was only one Chief Firearms Officer for all of Ontario, they are out of Orillia.

Anytime I have called them they have been really good and very accommodating, including details around a death in the family and working with a non-firearms owner who was the Executor of the Estate.

It won't be a CFO that has the guns. Many police detachments have a Firearms Officer. That will likely be whom you're dealing with.

The sad part is even though you've done nothing wrong, I doubt your guns were handled carefully. Likely piled into the trunk of a cruiser and rattled back to the station ,carried by the armload. :(

CFO contacted my Ex, and even though is an incident record with leo, I've had no problems since. Nowhere near quite as bad as your situation, and thankfully the officer involved was himself divorced so had plenty of real world experience with different things that can happen. Smart enoug to take her phone and read her text messages to me and then giver her a slap.

That said, during our conversation the one thing he said to me and its stayed with me ever since.
Next time she tries to have you arrested, she might not get a guy like me, thats lived life. It could be some hot eager fresh out of school kid that eager to make a mark , or a female officer who may be just that wee bit more sympathetic or careful. Consider yourself a little lucky.

Fox is right, they cant afford, not to take accusations seriously and have a bad well deserved reputation. In the years since I've met a woman (two actually with stalker issues), nether have much thats good to say about leo.

Point being, while your situation is different. Hopefully it works out well, but as others have noted. CYA going forward for awhile. Im sure most divorced people (both sexes) will agree. Things tend to get worse..........before they start to get better. Mine was a nightmare, but these days things are ok.

After I caught her screwin' around while I was at work,then lying her a** off,I cut her a cheque (OK,a bit of an over-simplification for brevity sake),told her to go and live with her layabout boyfriend and to get out of my life and stay out. Drop by the Courthouse on family court day. Where else will you see two people in their late 20s or early 30s with nothing on the balance sheet, and no assets, pay a pair of lawyers $300 per hour to argue over who gets the $300 Xbox......

Everyone said aren't you glad its over? No way over at trial end. Trials end just allowed me to get into the starting blocks. Some on here that truly know me, know that theres better things one can do than becomming my project

Statistically near everything you read, will say. It takes 7 years for people to recover.

At first, as I was heading into divorce I thought they meant financially.
Now, I know, it's more than that.

My "ex".
Nice person (there are reasons we got married to begin with).

Despite our problems and some ship, well not just some, tons and I do mean tons, which included trying to have arrested, leaving me the proverbial "Dear John letter and empty home" while I was facing cancer and potentially my ticket being punched to be with her boss...and so many other things, one of the first women I got serious with post divorce once said to me "John I need a divorce from your Ex"...needless to say in the end things took their toll and it didn't work out).

I will never ever take those things away from her. And ultimately no matter how much damage and collateral damage there is. "Everyone is allowed to be happy" and that includes her.

Things will probably get worse.
before they start getting better.

Prepare for the worst and hope for the best.

Been there,....and then some.I can't begin to relate just a fraction of it, nor the prices I've paid, that go way beyond financial prices and I got raped, Ill work to the grave as a result. But to add it just one more thing amongst many. When she tried to pull a fast one, and it was so low, so dirty, so flat out wrong, and gain custody of the kids as well. My lawyer gave me some advice.

I can rhyme off a good 6 friends ( Guys and Gals) for whom things......just got worse and worse. One girl I know is near bankrupt now, its been 9 years and it still hasn't settled...Talk to her today and she wishes she had just signed off on it and him years ago. As BBD and a couple others said.....At one point, I asked my lawyer to do anything, is there anything I could legally do, to get as far away as possible, keep her as far away and out of my life as possible. I was ready or getting close to the point where I was considering leaving the province or country, even though it might mean I had to leave my kids behind......One forum member here can vouch that, he tried to get me to go West and if not for my girls.....

It looks like you've already "won" the battles,especially,with the possibility she could end up doing time,but,if you can't cut it loose,take time to shake it off and put as much distance between you and the kids and her,she'll just keep going and going and going like the EverReady rabbit. Actually my main issue now is the cops ignoring 6 attempts I've made with them to talk about gun return. 2 by phone 2 by writing 2 by going there. As usual they loose cause they don't do investigation before charging and as usual they go into pout after losing

If the cops actually return your firearms the first thing I would do is sell them all ( including signed bill of sale) to a trusted friend or relative who has a PAL until this gets settled. If she tries this again the cops can't seize what's not there. Sorry to hear about all this. A buddy of mine has been in court for 3 years and just got joint custody of his kids. Huge $$$ legal bills on both sides.

one of my family friends is going through this . she cheated on him for 4 years, took off with her boyfriend and forced to provide alimony because her life is not as good as it was with her new boyfriend. So separated husband has to pay her monthly while she left two kids, one recently graduated from university and another one he is putting through. not to mention a hunter in the family and she has her fingers on the buttons to call it in anytime.... totally unfair to him. committed to family, work and good life for 25 years.

Decades ago, abused wives stayed in marriages and people who shouldn't have stayed together did because of the stigma. Couple that with many women being screwed once upon a time, in trying to right that, the court pendulum.........

These days they are just too easy. But we are after all a consumer society. Buy something, wear/use it for a few years, toss it and buy the newest model.

These days, wtf knows. Read some stats a long time ago that said 75% of all divorces are initiated by women. Do I believe that? Well theres a saying.

GUNS AND ALL SEIZED ARTICLES COME BACK AUTOMATICALLY AFTER 1 MONTH. 1 MONTH IS THE TIME FRAME FOR EACH SIDE TO APPEAL (no rick i wont get appealed) SO THEY JUST INSTITUTED A 30 DAY HOLD ABOUT 4 YRS BACK CAUSE TOO MANY THINGS WERE GETTING RETURNED BY EITHER SIDE ONLY TO HAVE TO GO THROUGH THE PROCESS AGAIN. SHORT ANSWER IS MY STUFF IS COMING BACK I'M JUST IN A PROCEDURAL WINDOW TILL THE 24TH. CAN I GET AN AMEN

Amen. But I stand by my first post. I would sell them all to a trusted friend until this is over in case she turns on you again if things don't go her way. The cops can't sieze what you don't own and if she accused you of threatening her with them and police determine you don't have any it totally discredits her.

What does "selling a gun" mean since registry gone,and. God finding someone to get invloved and for the amount I have is near impossible. This is the era of "i dont wanta get involved"

What Terry was alluding to was to " give " the firearms to a trusted friend until this blows over and then he can "give them back to you" . If she comes up with any wild accusations you can tell the cops you don't own the guns any more you " sold / gave " them to a friend.

X2. Take all firearms completely out of the equation,especially,when an "X" is dealing with mental/substance abuse. It's also important to keep your mouth shut as to where they went. No need to discuss it with anyone.

Can't give this (and Terrym's comments) enough thumbs up.

I've had 2 friends go through this (one of them has had it happen with 2 or 3 different gf's - he knows how to pick'em!) and they BOTH had major recurring issues after the initial breakup and seizure.

One woman dropped off the face of the planet for almost 2 years and my buddy thought he was free and clear of her (his guns were seized for almost a full year during their initial court battle) and all of a sudden she comes back and calls the police with an anonymous tip that he's threatened his own kids with gun violence.

And the whole process started all over again. So for most of the last decade, he had a PAL and a hunting license but "owned" no guns as he "gave" all his away to friends and family and then "borrowed" them for hunting seasons.

Well as i suspected. The cops talk about return of properties (including guns). Talk about calling me to arrange time. Talk about it being no prob, yet we're weeks after the post trial appeal wait period and still nothing. How long till i pay lawyer to send them a letter?

You really need to find out why they're stalling. Contact the local Crown Attorney's office,first. Then,the Police. If they still screw you around,get to a lawyer because something is going on in the background you need to know about.

I don't know if it came up but I would suggest contacting someone at one of the Canadian Firearms associations and see if they can provide some guidance on how to proceed. They might not have a clue .... or they might have seen it before or they might even get behind you if it looks like something they are concerned with. Might be a waste of time or they might have dealt with this several times already ?????
