OK,so,picture this. Last week,one of our home-grown terrorist wannabe whack jobs leave Montreal,travel to the US and almost kills an airport cop by stabbing him in the throat,claiming allegiance to ISIS,after attempting to (and failing) to buy a firearm stateside. Today,on US Independence Day,the Trudeau Liberals decide to issue an apology and huge cash award to Kadr,an Afghan terrorist bomb maker and enemy combatant pledging allegiance to Al Qaeda, adding insult to injury. Now,this is just me talking,but,honestly,if I was Donald Trump,I'd recall the US Ambassador,issue a formal diplomatic protest and all bets would be off as far as NAFTA rework,every contract ever signed with Canada for anything,tighten the borders to the point of near strangulation and as far as mutual defense is concerned,tell Canada that from this day on,they're completely on their own and they've got 30 days to cough up every nickel owed for NATO.

There is a bright side on all of this. People are so disgusted by the move that its another nail in the Liberals coffin.

The optics on this is terrible on so many levels.

This guy is a Canadian citizen whether we like it or not. He was born here into a family who's loyalty to the country of Canada is dubious at best. He and his family took up arms against Canada and her allies in the Afgan War. He has admitted to killing Speer and wounding Morris along with a host of other things during the war. These confessions have been made during a period which Khadr was allegedly tortured (a military judge ruled he was not being tortured). The Obama admin started pressuring the Canadian government to take him because they didn't have the willpower to try a child for war crimes. Canadian government relented, Khadr was repatriated to serve out his remaining time and after he was done he decided to sue the government for violating his rights per the Supreme Court's ruling. Rather than risk a court battle that they would probably lose, the Canadian government cut him a cheque to go away.

We should have dealt with this clown from the very beginning. As soon as the US picked him up, we should have been asking for him to be returned to be charged with High Treason and we should have been lobbying the court to try him as an adult. He was old enough to pick up a firearm and grenades and shoot at soldiers, he is old enough to take the consequences of those actions under our laws. If the US didn't want to give him up, then so be it. When other Canadians run afoul of the law in other countries, the person is under the country's jurisdiction and bound to follow the legal system of that country. However, the government of Canada still has certain responsibilities to the Canadian (that includes even this guy). However, the government didn't have the intestinal fortitude to deal with him at the time and then made even more mistakes when they gave the information they obtained it their interrogations with him to the US.

There is alot to be mad about this situation. But the responsibility is on the government and it's agencies to conduct itself within the law when dealing with it's citizens. The rights that the Supreme Court ruled were violated is the the same rights all of us have and giving a pass to one Canadian's rights being violated opens a pandora's box to allow other Canadian's rights to be violated.

Some may think I am defending Khadr. I am not. I think he was a willing combatant in a war despite him being 15 at the time. I think he is a traitor to Canada and should be arrested and tried as such. I don't believe for a second he is apologetic for his actions and that he has changed his beliefs despite what he has said. Actions speak louder than words and if he was truly apologetic, he would be voluntarily turning that money over to Speer's widow and Morris and quietly be thankful that he is alive today.

There are so many "parts and components/chemicals that come out of Canada which are not being made in the states. 60 to 70% of trucks picking up produce in the states are heading to Canada. Even seed for crops comes out of the states. The EPA in the states has in some cases made it impossible to even produce something needed for manufacturing. US wood product producers may scream about soft wood, but the EPA would prevent them from ever being able to meet demand for building supplies in the US.

The SCC of Canada ruled years ago that Canada first under Chretien and Martin failed to fight for a Canadian citizen as required by Canadian & International laws and than Harper failed to do so also and Harper went even further by disregarding a SCC ruling for him to do so.
Yes the Canadian Government failed him as required by law & this is why we are at this point.
If the Canadian Government would have petitioned to bring him back here & tried him under Canadian & International laws we would not be here at this stage.
With the previous SCC rulings there is no way the government wouldn't lose in a law suit.

You are correct. However, no where in the SCC ruling was any compensation mentioned; nor was Khadr seeking any during the SCC proceedings. In his civil suit, he would have been required to prove that Canada conspired with the US for his treatment and we are liable for doing it. He has not done this; nor, with the nice shiny settlement, will he ever have to do this. Would the government lose? Probably. Would they have had to pay the full amount? Probably not. When my wife and I were involved in a civil lawsuit, our lawyer told us the worse thing is a civil case going to trial because of all the uncertainty involved. The onus is on the plantiff to convince a judge that the defendant has wronged them under the law and then convince the judge that they are owed what they are asking for. The government hasn't even given us a concrete explanation for this decision, just platitudes about the judicial process (despite no judicial process happening). They just rolled over and submitted like a dog who just had it's parts removed.

No. The SCC's ruling doesn't automatically predetermine a civil suit's outcome. The SCC's ruling was that Khadr was owed a remedy for the violation. The remedy which Khadr sought was repatriation which he got. He never asked for monetary compensation. When he got back to Canada, he alledged that the Canadian government conspired with the US to torture and breach his rights which a Federal judge found he should be allowed to claim in 2014. This allowed him to expand his civil suit which he was accusing Ottawa of complicity in what he claimed was his arbitrary detention and cruel and inhuman treatment at the hands of the Americans.

It would be up to Khadr to prove to a court (judge and jury) that he was owed compensation for the SCC's ruling and the PM's decision. He would have had to prove that the government of Canada was liable for what happened to him. By settling, the Liberals have not made him do any of that. Their argument from when this was announced has been since his rights were violated, he should get compensation. They even commented on Friday you can't ignore the SCC's ruling. Khadr got his compensation from the SCC's ruling. He came home. He even got a reduced sentence. The government met it's obligation under the SCC's ruling. The SCC's ruling while is the basis for the civil case, doesn't determine the outcome of the civil case. However, he wanted more and the government rolled over under the pretense of the SCC's ruling and the claim they wanted to save taxpayers money (really this Liberal government making that claim should have sent alarms ringing). Khadr believes(believed) he was owed more redress so it should be put before a judge and let the judge rule if the government owes him more compensation. It is very rare in Canada that a plaintiff in a civil suit gets the full amount that they seek. He is playing the victim still and no one is buying except the Liberals and their supporters. He could have quietly gone away, tried to rebuild his life, been thankful that he got what he wanted and tried to put his past behind him. However, he has routinely sought more and more and more and most people are sick of his song and dance and aren't willing to put up with it anymore.

I wonder if FinTrac watched where the money went. Guaran-damn-teed it was out of Canada within 10 seconds by government transfer.

My bet now is that the Liberals get Khadr a new identity because the Sun said he lives in Mississauga and they must know nobody will hire this criminal so they will keep helping him.

The Federal rulings were on whether Khadr could bring his civil suit to court and the SCC ruling was whether the government violated his rights. I agree the civil suit probably would have been lost. I don't think anyone is arguing that point. However, because the government rolled over on it's back, like a newly neutered dog, for Khadr because it believes settling is a better way to deal with this than a court case and they wanted this to go away. I disagree and I think they should fight it in court until the very last. I am ok with a judge's decision if it went against us on this matter. I am not ok with giving a person who has never face the consequences of his "alleged" criminal actions in a Canadian court (yes I am talking about High Treason and I acknowledge your point about the three previous governments failure to bring him up on charges because it was a political nightmare and all three govern) a hefty cheque and a hug without a fight. And according to this article 71% of Canadians polled agree that the government shouldn't have settled out of court (http://nationalpost.com/opinion/john...d-61f9f586ca59). Now the views start to digress as more questions about Khadr get asked but the majority of Canadians have the belief that settling out of court with Khadr was not the right move.

I don't think Harper spent $100 million. The total for the court proceedings is $5 million (per the government's numbers in the news conference) for the past 15 years of court battles. Let's stop trying to lay the blame with Harper over this. Chretien and Martin did squat about Khadr when they were the PM when this entire mess started (actually no government dealt with his family which is where this mess started). Laying this mess all on Harper opens the door for the argument that Harper was following the previous PM's lead on how to deal with this guy. No politician wanted to touch this guy because he was/is toxic and now the Liberals are trying to clean up a dog's breakfast but in my opinion, they did it the wrong way.

A judge ruled against him on her behalf in Utah I believe for 134million and she/lawyers were asking Canada(an Ontario Judge)to freeze any assets.

She never had a judgement against Omar Khadr.
Her and Layne Morris's judgement was against Omar's father Ahmad Said Khadr.
No where was Omar listed as a defendant.

Btw: The US government seized all of Ahmad Khadr's money for themselves and have refused giving it to to complainants.
Another thing is this case was in 2006. In 2008 Layne recanted his testimony about Omar throwing the grenade before Omar's trial. Reason for recanting it was because the lone survivor of the attack which Speer's was killed stated there was no way that Morris could have seen Omar throw the grenade do to the fact that Morris was injured earlier and was evacuated before the attack that killed Speer's happened. No one at Omar's trial could state that they seen him throw the grenade.

Long,dry read is right. It still doesn't alter the fact that there IS a judgement against Omar Khadr and the Liberals paid it out in such a way as to protect that payment from being frozen. That fact,alone,now,makes them complicit. This was not well thought out,at all. It brings Canada and Canadians to look like a nation of terrorist sympathizers,adding fuel to the fire that we can't be trusted in the global fight against Al Qaeda and ISIS/ISIL.

Did YOU read the link you posted? It clearly explains the suit, precedent consideration, defendants, plaintiff's standing and settlement.

Furthermore, the widow/lawyers have asked Canada via a petition filed in Ontario Superior Court to hold any monies to be paid to Omar Khadr AND RECOGNIZE AND HONOR THE SETTLEMENT AGAINST HIM IN UTAH 2015.

It also asks for interest accrued and lawyer fees of 900,000 dollars.

Apparently, the radical hugging left regime of Turdo have circumvented that.

How does one attribute any moral equivalency between a terrorist and a "soldier" as described and accepted by all the world's law including the Geneva Convention etal.

He was NOT a child soldier by any definition of any a law other than the spineless left and a shameful toy soldier like Dallaire.

Interesting read. The report said Khadr was sitting up and moving, with his back to the combatant, while the other combatant was lying on his side. If Khadr was in as bad of shape as the report makes him out (having sustained the wounds to his eyes), he would be lying down as opposed to sitting up and not mobile, rather than moving around. I have had a few concussions from sports and the last thing I wanted to do was move around. Furthermore, the report says Khadr had his back turned when the grenade was thrown. So he was moving when OC-1 shot him but somehow we are to believe he stayed completely immobile within the 90 seconds from beginning of compound approach to him getting shot? That is a big leap of logic. I suppose it comes down to who is the more credible witness about who threw the grenade. A person who has taken up arms against the country of his birth or a soldier from an allied nation who determined that Khadr threw the grenade based on what he saw when he got into the compound. I know who I find a more reliable witness.

Now Khadr is changing his story about what happened. He doesn't remember throwing the grenade which killed Speer. So which is it? Did he or did he not do it? When he apologized to Speer's widow, he took responsibility for his actions. Now does his statements mean he doesn't? I find it funny that in the 1940's young people who were underage were volunteering to war and many of them were 15 years old (and some of them got in). Throughout the decades, we have acknowledged their actions as a 15 year old combatant but there are some out there who can't acknowledge Khadr was a combatant at 15 years old.
