My take on it would be as long as you unload and encase your firearm by 7 PM you can observe all you like, but I'm not a CO.

I know personally if I had a Tom or a group of birds just out of range and right in front of me at the end of legal time I would unload, encase and wait for the birds to move away before leaving. That might take 5 minutes or might take an hour.

Two seasons ago I shot a Tom at around 6:55. I unloaded and encased the shotgun. Tagged the bird, took some pictures. Milled around a bit packing up and telling the story to my buddy. By the time we got the the truck it was close to 8. If we met a CO at the truck he would surely ask some questions but neither of us were hunting past 7.

Edit: Sorry rossh I meant to quote your post/question before replying.

Here's another way to look at it... lots of people sit in their blinds an hour or more before legal light, but they're not hunting until they take the gun out and load it half an hour before sunrise.

That's still more understandable then coming out a few hours later after legal time. Unless you are tracking down the animal that you shot before legal light was up.
If Turkey ends at 7 and you come out at 9 well you better have some explanation of why you were out there so long . See the difference? the legal light and legal Turkey time is way off and different. Still have a almost an hour and half of legal light after the legal time of the Turkey right?

Who is to say he wouldn't shoot a bird at 815 ? Only him . Put the gun back away and go back to the Bush and do your thing. Totally safer if stopped by the co why you coming out an hour and half later with a firearm? Your not tracking an animal you have a gun on your possession hours after the legal hunt who says your not hunting?

How does the CO know I'm not sitting with a loaded gun in the blind at 4:30 am? I don't walk back to the truck at legal light to get my shotgun.

Respectfully, you're over thinking this a little.

Here is another example not hunting but fishing. I fish 2 spots in the spring for walleye. Both spots have 2 separate regulations different slot sizes and catch limits one is 3 and the other 4 . What will happen if I'm at spot 2 with a fish I got from spot 1 an hour earlier? I'm fishing an area that has a less of a limit and the fish size does not match the zone I'm in? But hey I'm fishing there and now I have fish the wrong size to keep? What will happen if a co checks my vehicle?

Unless I have the proof witch I always do because I make sure I take plenty of pics of the background and the fish. With out this proof I guess I could be facing some fines for having fish that are out slot size in that zone.
Same thing will happen in a case like this I guess it would be up to the co . Depends on how he feels I guess coming out an hour an a half after legal shooting time and it's still light out side. He could be 100 % poaching, it's still light out you can see what your doing still the sun is just starting to set. Yet he still has a firearm on him.
Always better to play it safe take the gun back to the truck at 7 and carry on with your day. A pic a 7 with a trigger lock on means nothing so there is nothing to prove you really stopped hunting unless your without the firearm. Maybe you own the property and doing chores after the hunt maybe be an easier excuse as to why you still have your gun on you. Who knows what the co will think about it. Do you really want to risk it?

Sorry to hi Jack the thread maybe he should of started his own.

    Congrats on the bird.

Maybe so to be on the safer side of things. With less of a hassle and trying to explain myself.

Either way you look at it. He is out with a firearm after legal shooting time, looking for birds in legal light. Explain away I guess.

Yes, sorry to hijack the thread OP, but I guess it's somewhat relevant considering how the thread started.

You're correct about the discretion of the CO fishfood, as is the case in many, many situations while fishing and hunting. On that we can agree.

I suppose if you want to go to all those extremes to be on the safe side of things that's up to you. Personally, worrying about every little detail (to the point of completely unnecessary trigger locks) takes the enjoyment out of things for me. As long as I'm doing what I say I'm doing and a CO charges me anyway, I guess I'll have my day in court.

I can understand why some people go to these extremes though. When it comes to hunting and fishing, sometimes it seems we're guilty until proven innocent.
