Police on Guard for Thee
We have received many questions regarding the new restrictions in Ontario.
As we have stated before, the Emergency Management Civil Protection Act and Reopening Ontario Act do not supersede the Charter as stated in 7.0.2 of the EMCPA.
Police have no authority to arbitrarily detain and question anyone for the sole purpose of a public health measure investigation.
To this point we have seen various responses from different services and associations (Reference the photos). The law is the law. Why the different responses? Because it's not about the law it's political.
Just yesterday Toronto police tweeted about the collection of identifying information in certain circumstances (CIICC) Ontario Regulation 58/16 prohibiting the collection of information when there is no authority to do so.
Hours later the provincial government announced new police powers. These powers are unconstitutional.
The measures under the ROA and stay at home order are also Ontario Regulations. Same type of legislation, yet contradictory. One says police can't stop an individual while the other says they can.
That being said if you are operating a motor vehicle and stopped by police you are required to identify yourself under the Highway Traffic Act. You are not required to answer any questions regarding the reason for being outside your home.

So I suppose if someone stole your vehicle from your workplace, at 02:00, you wouldn't be upset that a cop didn't stop them to check on things?
Unless the car is reported stolen it doesn't matter, why would they look for a stolen vehicle if it's not reported stolen yet lol?
Sorry no excuse to pull you over to see if you are in a stolen vehicle to funny.
However I have been pulled over for being a male registered to a female driver. Cop got pissy with me when I question him if that was even a reason.
I've been out and will be again if I get a ticket for something stupid i won't pay anything. It can sit and collect interest as I won't have any interest in paying it.

Well, Ford got his fingers slapped and they are backing down.
"Furious criticism of new anti-pandemic powers that allow police in Ontario to stop any motorist or pedestrian and ask where they live and why they’re not home prompted the provincial government on Saturday to reconsider the measures."

May not have been his idea and right now he who controls the vaccines can make the rules unfortunately I SUSPECT. The numbers did set a new record so there was SOME justification but not much. Good he backed down, he was looking more like the guy Tucker was talking about here...

Print this little press release off and keep it on your wallet...it's your 'get out of jail (fine) card'.
Later, Solicitor General Sylvia Jones said in a statement that police officers will only stop people suspected of participating in an “organized public event or social gathering,” not question people about why they are outside, or demand their home address.
There was a particular irony in the Ford government initially giving police new powers to question people walking on the street or in their cars, in that they basically amounted to re-instituting police street checks.
They were abandoned in Ontario after 2014 on the grounds they were racist and disproportionately targeted Blacks

Looks like the police services of Ontario have our backs on this. Almost unanimous support by them to reject random stops.
Multiple police services indicated many forces didn't want to take on this responsibility.
The president of the Peel Regional Police Association, for example, took to Twitter to urge the government: "Don't make cops the bad guys here!"
In a subsequent statement, Peel Regional Police confirmed it would not conduct "random vehicle or individual stops."
Police in the Ontario municipalities of Toronto, Hamilton, Peterborough, London, Waterloo, Niagara, Ottawa, York Region, Windsor and Cornwall had all released similar statements.

X2-I expected a whole lot from him. He clearly shows lack of balance and Political awareness.
It would be in the best interest of Him-the PC ,and Ontario-if he would resign.
