Her defence was, she was not responsible for placing the bait, that she only arrived at the marsh to hunt in the dark, and had no knowledge of the bait. It was the Chappin decision if I remember correctly.
As far as seizing the dog, I highly doubt that as the dog was not used in the commission of any offence. She is only used to retrieve an already harvested bird.
That makes sense Rick, I don't think CO's are "out to get" you, but was curious if someone was really putting the gears to them and pushing all the wrong buttons, if they could hit them where it hurts and confiscate the animal as well.

I just asked my buddy who is an Ontario CO. His answer was no way. Not worth the trouble.
I’m suspicious of people who don't like dogs, but I trust a dog who doesn't like a person.

I think a bad situation would quickly escalate to a serious situation if someone was trying to seize a dog !!!

Right you are. CO's or any LEO for that matter will react in a manner that reflects the manner in which he/she is treated. You will get what you dish out.....only a lot worse !!

The logistics of dealing with a dog aren't of enough value in getting a conviction is how he put it. Cases could be months before court date. Now if you pizz off the CO's enough then they can and have been known to seize float planes and ATV's. Apparently most poachers cave on the spot when the CO's drop the tailgate and start loading up a seized ATV. Seems most poachers buy them on time and are more scared of coming home and explaining to the wife why she will now be making payments on a bike he had seized for breaking the law.

What if you have a buddy or say, your wife doing the retrieving? Could they confiscate her?
Or.....maybe they just fine the dog?
kidding of course, never really thought about it but Terry seems to have the most credible and logical answer......

Sieze the dog! Cold dead hands come to mind, take what you want but don't screw with my dog, that's fighting talk right there and I would probably go down if it came to that.
But I seriously don't think that they would do that.
