It doesn't say it in the act specifically but the restriction is there.
Just about every muni in Ontario references dealing with trapping nuisance animals in their by-laws. And I also spoke to a MNRF rep a few years back as to what I was permitted to do when I was dealing with squirrels. (release or kill)

It's a stupid regulation but the government wants to mitigate the possible transmission of disease - at least that was what was explained to me.
Like I said. The OP can do what he likes. But in a professional environment years ago, trapped raccons / skunks received a spray paint tag at the base of the tail, before we re-located them. we found anything under 12 km would result in just burning gas. 1km literally meant it would be 20mins, and they'd be back.
^No argument from me. I said the same thing to the MNRF rep I was speaking to. My only point is to point out the law.
This is actually the correct section:
Protection of property
31. (1) If a person believes on reasonable grounds that wildlife is damaging or is about to damage the person’s property, the person may, on the person’s land,
(a) harass the wildlife for the purpose of deterring it from damaging the person’s property; or
(b) capture or kill the wildlife. 1997, c. 41, s. 31 (1).(8)
Capture and release
(8) Subsection 40 (1) and section 46 do not apply to a person who captures wildlife under this section and releases it in accordance with the regulations or in accordance with an authorization of the Minister. 1997, c. 41, s. 31 (8).
no sure how many years ago you did this but MNR changed the rules regarding relocation of wildlife because there were so many so called professional wildlife removal companies doing what you just said and dumping problem wildlife on others and transmitting disease over areas that it never would have spread over on its own
Thanks to everyone for all the information. I now have many things to try and hopefully I can actually catch the one that is under the house and not others that seem to be roaming the area. Will keep posting on success.
Let me clarify "professional environment" means we were the Property Services Dept. in the employ of the owner of the large property, not wildlife removal.
FWIW, I'd like to see the MNRs data saying that 12km would be out of the normal range of spread. I'm sure this had mostly to do with Pest Control Companies in built up areas simply dumping trapped wildlife in the burbs....
