Police Can't Stop Cars

Well there you go, right from the Solicitor General's office...go outdside and hunt and Fish...just don't break any distancing rules.

TORONTO — A stay-at-home order went into effect in Ontario on Thursday but the government said police would not have the authority to randomly stop residents on the street to ensure compliance.

The measure, imposed in an effort to bring down soaring rates of COVID-19, means Ontarians are to venture out only for essential purposes such as health-care, food and exercise.

A spokesman for Solicitor General Sylvia Jones said the order doesn’t give police the power to enter homes or stop vehicles solely to check if the measure is being followed. Residents travelling to work are also not required to have proof from their boss that they are doing so.

“On its own, being outside is not sufficient evidence of a failure to comply with the stay-at-home order,” spokesman Stephen Warner said.

Critics have called the stay-at-home order unclear but Premier Doug Ford has asked residents to use their “best judgment” in deciding whether to go out.

Several police forces said they were still reviewing the details of the measure. The province sent police services a memo on enforcing the order but refused to make it public.

Peel police say they’ll respond to complaints
A spokeswoman for Peel Regional Police said the service planned to respond to complaints about violations of the order but would not be stopping drivers and pedestrians to see where they are going.

“It will be for the most part responding to calls,” Const. Sarah Patten said in a statement.

Toronto’s police chief said his force would release more details later and asked residents to do their part and stay home.

Interesting concept. Can you elaborate on the 'agenda', that involves that group of more than 5? I don't think prevention of transmission is what you had in mind.

Which activity do you prefer?
One is illegal and the other one is not. Care to identify and explain the rationale behind it? Some of us need a better explanation.

Was stopped yesterday by the OPP in a one cop ride program. Asked him what was up. He said it’s a “ride program” to let everyone know about the emergency measures.

Where there is a will there is a way.

Would a check point be different than just stopping random cars. ?

Would be a like a ride no a grey area for the cops.

I think what he is saying that they can't just pull you over without a reason. You get pulled over for speeding they have the right to ask why you are out.

A check point or a cop waiting with the mnr checking fishing license at an access point .. or a ride could give authority to ask where you live and why you are out.

The ministry does it all the time for ‘fish checks ‘ leaving Lake Simcoe. Many roads in and out of access points have ministry staff, OPP and fish smelling dogs. I never thought that was right , pulling people over because they looked like fishermen. Nothing more.

As for one being legal and one not the answer is simple.
One is under Federal control while the other falls under Provincial control.

Driving across 7A today I saw two OPP cruisers off to the side. Speed traps? Possibly.
But awfully coincidental.....

I don’t mind. I’ve suggested for awhile now they should have been using RIDE like set ups, going way back. Especially in problem areas. It’s a deterrent. Maybe enough to get some to “think twice”, about going to a friends for an evening, driving hither and yonder.

Might take some flak for this. And I really don’t know. But my assumption would be that over all law enforcement are nowhere near as busy ( # of calls) as they were in 2019.

Some things are likely increasing like domestics. But with so many working from home, staying home, going out less, I have to believe accidents are down, petty crime like break ins down etc.

Drivers can be stopped to check for license,ownership and insurance under the Highway Traffic Act. CO's pulled me over on Hwy 115 last fall because they noticed my orange cap sitting on the dash as they passed me. It's R&PG under the FWCA. No matter what the civil rights people say,Police have a way around almost everything in this country.

Well... at least we have dash cams and a camera in every pocket. A little harder for them to provide an ‘ alternate ‘ story now. They should have body cameras that cannot be turned off.

Police checking drivers on 118 in Carnarvon tonight around 6pm, only checking 1 side of the intersection heading toward Haliburton so I didn't get to find out why.

Just put a camera on them record if your stopped, they not so like..:D

I heard of a charge this weekend. Car with 4 guys in it was stopped by a cop, and they were asked to present IDs (I assume under suspicion they were from different households and therefore breaking the stay at home order). They were from different households and charged.

I don’t buy Fords bs or Leo’s for one second. They can pull us over for almost any reason. RIDE is an obvious example, and if I’m not mistaken they gained even more “power” to when weed was legalized a year ago.

I suspect it’s more about political will. And not wanting to annoy some.

We can expect the current "lockdown lite" will be further strengthened if case loads do not decrease. The powers of the province in a declared state of emergency are very far reaching.
