Stand on Crown Land

I hunt on crown land and went to check my stand last week and saw that someone dumped a load of carrots in front of the stand about 20 yards away. They cleared a shooting lane and set up their trail camera on the tree that the stand is on. I was planning on using it for the moose and deer rifle hunt. Hoping that they will be using if for the deer bow hunt and leave the stand there when they leave. Just don't want any issues. I've been hunting that area for the last 30 years and never had that happen. If i see someones stand I just find another spot. I was thinking about leaving my info to get in contact. Any ideas would be appreciated.

This is the problem with crownland...... In my neck of the woods, crownland is few and far between so it upsets me seeing a tree stand there as it implies rights to the area.
Anyway, I hope you get it sorted out and it works out well for the both of you.

ahh thats a tough one, i for one would not leave it there after that. but thats just my opinion.

on another note if i went on someones tree stand and say a kindly written note i may or may not get in contact with you.

its a risk that i wouldnt take but to each their own.

Leaving contact info is certainly a very good idea in this case.

Bait and a camera on a "found" stand? I'm amazed somebody would do that to be honest. Maybe they figured it was abandoned.

I think contact info would be a good idea, one area I hunt has a gun stand that I will only go in that area after the gun season, now that I know it's there.

What type of stand have you left? I agree with leaving a calling card, who knows maybe a friendship will develop.

It's a tough one, Had you already baited or done anything this year that would show you were planning to use it. Personally I won't use someone else stand but it's possible that someone could take mine.

I try to avoid other hunters and try to hunt in areas where others aren’t. If I found someone else’s stand, I might hunt from it if I thought that I wouldn’t interrupt someone’s hunt, or just I would just leave the area.

Last fall, I explored an area of Crown land and found a ladder stand along an old skidded road. Based on the age of the tracks in the snow, I was confident that the group that owned the stand had hunted the week before and had gone home. I followed their tracks around to see what they had been up to and whether they left more stands out.

Had the other hunters still been in the area, I would have left the area to them. But since they were gone, I felt free to explore the area. I might have used the ladder stand if the deer sign was there, but there wasn’t a lot there at the time.

I plan to go back there and explore some more this fall, unfortunately the loggers are going back there this winter to cut the remaining timber that they left 10 years ago. Once that’s cut, there won’t be any large blocks of standing deer bush left in that area. Thats been the trend up here for the last 15 years. :(

Stands on crown land are regarded the same as duck blinds on lakes. No matter who built it,first come first served. I don't build permanent stands on crown or blinds on navigable water specifically for that reason. I don't need the aggravation,besides,I've had much more success going into the bush in "stealth mode" or rigging the boat as a portable duck blind. There's a lot less BS.

Thank you for the replies. I will keep you posted on what happens. I will check this weekend to see if anyone is hunting there and hopefully work out a plan for both parties.

I think it would be a lot less complicated if folk's just obeyed the laws which were set up to prevent some of the problems experienced by the OP.

"Unauthorized depositing
27 (1) Except with the written consent of the Minister or an officer authorized by the Minister, no person shall deposit or cause to be deposited any material, substance or thing,

(a) on public lands, whether or not the lands are covered with water or ice; or

(b) on water or ice covering public lands. 2010, c. 16, Sched. 10, s. 4 (2).

I leave a couple ladder stands on crown land, I had same scenerio happen 3 years ago, left my info, no contact, one afternoon walk in and someone in my stand, ask him if he got his note and all he said was first come first served,
I said no problem, I walked away circled and came back and sat down on the ground against tree. He said your waiting here, yup I like this spot and no one was sitting against this tree.
Needless to say that was the last time I ever saw this person and was never an issue again.
During the gun season I will leave a note, treat it like its yours and it will be here next year for you to use again, and again never an issue

He was right. Having a stand there does not give you possession of the spot on public land. It sound like it was pretty mean of you to sit what sounds close to him to pressure him to leave. How would you like someone doing that to you? I would not be so easily discouraged by that tactic.

This is a controversial topic for sure,and i can see both sides of the coin.

I think hockeymjt did the right thing.Avoided confrontation,and made the point.

What would You do -if this happnes to your stand?

Definitely a controversial topic.

He definitely did the right thing to avoid a confrontation, but In my view he should have graciously left, as the other hunter was there first, and let the hunter enjoy his hunt, not sit what sounds close to him, to allegedly pressure him not to use his stand.

Yes it was his stand, but in that case if someone was hell bent on using that spot, or to make a point, they could put up their own stand next to his and no one could say boo. Would that be better?

No one wins by not being respectful and ethical on use of crown land. We need to share and it is first come first serve.

I think it makes a big difference and "ethical " changes based on the amount of crown in your hunting location.

There's a fair bit of crown around here and most folks and gangs are respectful of others traditional areas. There are a few squabbles and guys will push the lines a bit but it takes a real group of dingleberries to stomp into another guys area.

When the moose hunt is on, all bets are off , it's like a feeding frenzy when the truckers start blabbing about the bull they saw at km7 on the ticklesack road.

My thought are, if there's a stand there Tha has been used recently, stay away from it, don't be lazy and find your own spot.

I would tell the guy up in my stand that he can have the spot but I'm taking my treestand somewhere else. Make sure your name is written all over it to avoid confusion as to who owns what.

Oh geez that would be bad with an older guy like me having a weaker bladder and always peeing off my stand. It could even get worse if I have had my Scottish Porridge Oats followed by a Timmies coffee which always makes me very "argent".

Can I just put a 5 gallon pale with my name on it to claim my spot or does it have to be a tree stand. Or how about I put an a big X on the trees I want to sit up against, do they become my spots too.
Is it first person to claim the spot gets to keep it for how long they want (years/decades) or is it first person to show up that day gets to claim it for the day.

LOL it depends on who you ask. If its a bunch of local boys who have been hunting a parcel of Crown land for the past 30 years
and you show up as a new guy they will be fast to tell you they have hunted there and expect exclusive use.

Mind you the MNR encouraged this type of possessive behavior with their decades old policies of Crown Permits and leases for hunt camps.

I'd be pissed with the guy that sat in my stand but I can tell you he'd only do it once. I'd remove the stand as soon as possible. He'll be back with an attitude like that.

Well, first I would fully recognize that if I put up a stand, or anything for that matter on public land and I leave it there for an extended period of time that I am not there, It pretty much becomes public property as well. It's the chance you take when you leave your stuff there.

So, if I went there and found someone sitting in MY stand, first I would kick myself for not getting there earlier LOL, then I would wish the hunter luck and go to another spot that I hopefully have. Next time, if I wanted to use that spot, I would get there earlier.

I would certainly not escalate the situation or try to annoy the other hunter by sitting by a tree nearby and ruining his hunt, and mine too. Also risking a "soiled" stand like Gilroy talked about :scream:!

That's what I would do. Cheers!

Use a climber. Unlimited options and 100% portable. Never anyone in it when it's on your back.

Back in the day there were a few duck blinds on Rondeau Bay that were set ablaze, when the builder found a squatter !!

No, also as per Regulation 161/17, the 21day rule only applies to resident Crown land camping:

Camping units: private use
5. (1) A person is authorized to occupy public lands under section 21.1 of the Act for the purpose of erecting, placing or using a camping unit for private, non-commercial purposes only if the following conditions are met:

1. The person erects, places or uses the camping unit solely for non-commercial camping purposes.

There must be a time limit for how long a prescribed structure is on Crown land?

I always thought I read somewhere that u cant set up a permanent stand on crown ...thats why I use a climber ...

As long as the person requires it for hunting, then it can stay during the hunting seasons. I’ve also seen plywood blinds used for wolf hunting which extends into the winter.

Unfortunately there is no requirement to put your name or licence number on a stand so it can’t be traced back to the owner. The fact of the matter is that the MNR will not be out purposely looking for tree stands as they aren’t a priority. The bigger concern are the larger enclosed blinds that are permanent. I’ve seen ones on stilts that came complete with a propane stove, bunks, and spot lights.

Like Sam said, MNRF never bothered us with normal tree stands around here.
We hunted one area with success for a couple years all alone before a lone hunter started walking in the cut while we were in the tree stands.
He got up real early one morning to sit in my tree stand. When I got there in the dark, I politely asked him to get out of my tree stand. He told me to F off so I did.
I walked a mile back to the truck and got my chain saw, then walked back in. Once I got back to the tree stand he seen me coming and took off watching from a distance. I started my chainsaw and cut the birch tree my stand was in. I then cut up the platform and wood ladder in kiddling. I waved at him and walked back to my truck and drove down the road to check another cut, next day I shot a nice bull there.

Wow Deer Hunter! I can understand you were pissed, but wouldn't it been easier for you to go to your next cut a day earlier and maybe get your bull a day earlier?
You destroyed a stand that perhaps was only being used once by the other hunter, ruined your day and the other guy's day too I am sure. Who won out of this action?

Well,at least,he went back and got a chain saw and cut the tree down instead of cutting the valve stems off the guy's vehicle like I've seen done before. You're sure right on with lose,lose all the way around.

I did! It felt great at the time.
Around here you don't use other people tree stand or walk in a cut that’s hunted.
Its Northern Ontario, you drive a few more miles and find your own spot and hunt a cut nobody is in.
He's just lucky the full gang wasn’t there, at this point it was only me and my Buddy’s old man. He would of seen I was pretty civilized compared to my buddies lol.

I didn't lose nothing, we still had three tree stand in the cut. We also rebuilt a better stand with better visibility.
I also found another great cut that we hunted for years.
I don't have no use for lazy people that try to take advantage of others people hard work.
Im the most respectful hunter you will ever meet. I’ve helped lots of people in the bush over the years.

So, for the people who think using someone elses treestand on Crown land is cool, how about I stumble on your campsite you have set up on Crown to hunt from and set myself up in your tent? How can this be any different? You were not using it at the time were you?? Put your time in and don't piggy-back off someone elses hard work.

You may own the stand but not the area. If someone sets up in the area and you don't want them to use the stand move the stand.
Otherwise be prepared to share and make the best of it.

Thank you Finsfurfeathers, you said it correctly. I dont think this is about not wanting anyone to use your stands on public land, this is about not wanting anyone on the areas you placed your stands on. As he said, you don't own the land, therefore you must cooperate and share.

Deer Hunter, respectfully you said that you wont "walk in a cut that’s hunted", yet you did, even though the guy was there first, so what really bothered you, that the guy was in your stand or was in "your" (not) area?

I for one would not use someone else's tree stand, but I would absolutely not be chased out of a public hunting area that I know I have a right to be in and I was there first, and will use all legaI avenues at my disposal to preserve that right. Everyone has cell phones, cameras and trail cameras these days, and a call to the MNR and the OPP will be made at the first hint of a threat to me or my personal property from anyone trying to chase me out of an area I know I have every right to be in.

Fair enough and good point.
It sometimes hard to make a long story short.
I never told him he couldn’t hunt there, I asked him politely to get out of my tree stand.
This guy walked in the cut amongst us for days and we never said boo to him.
We are not criminals and never threatened no one.
If I can’t sit in my tree stand that I work my Azz off to haul in and build then it’s my privilege to dismantle it.

X 2- and for the ones hell bent -it is OK to use the stand built by someone else-how about the guy who wants to use other ppls hard work-erect his stand nearby?
He would do at least part of the work(scouting was already done for him!)but at least he would show sort of involvement and a respect for other ppls property.

At the end-if one has so much ethics to use it ,then be respectful and get out if the LEGAL owner asks You to do so-for his own use on the day.

If no one shows up on your hunt( in someone else's stand)-to claim his own stand for use-so much better for You.Do your hunt ,and be happy.

I am not fimilair as to where it states in the law that a spot becomes yours if your stand is on it. My understanding is on crown first come first serve. However I think respectable hunters would not take someone else stand. I have never had anyone take my spot yet (Knock wood).

But if they did I guess I would try and reason with them and if that didn't work I would just move on. I am quite capable of finding another spot. But I would remove my stand the earliest possible chance when they were not there. Would take me all of 1 hour to dismantle the tree stand.

There is no question a hunter is allowed to erect a tree stand on Crown land, the burning question is for how LONG?

Your take appears to be it stays until the end of the hunting season and as I pointed out there are many seasons you can run into back to back, starting with a Spring bear hunt and ending with a late season Moose hunt.

The problem is that some folk's leave their stand on purpose year after year in order to have EXCLUSIVE POSSESSION of an area of land to hunt on year after year to the exclusion of other hunters.

If you have built a permanent stand made of wood or what ever that cannot be easily removed IMHO its open to be used and its there against the spirit of the law.

If its a steel ladder stand affixed to a tree and easily removable then you would have to move off it if an owner arrived.

But that stand must be removed.

The law allows you to hang a stand, that’s it. The regulation doesn’t convey exclusive use to the surrounding area. A person would require legal possession of the land (either conveyed in the legislation or by an instrument e.g. a permit) to claim the surrounding area for themselves.

It all comes down to courtesy, respect and good manners. Unfortunately some people haven’t any at all.

I don't have a dime invested in the argument since I don't leave stands, or use other's stands. But the duck blinds have been mentioned and I have used another person's blind before, if I was challenged I would likely just move on or invite them in, depending on circumstance.

The same regulation allows you to construct a dock in front of your cottage. The dock belongs to you - your property and liability. The regulation also treats a duck blind and treestand the same… same rules.

Ok I will play the game with you, I put up my ladder stand at the start of Spring Bear hunt and hunt out of it a few weekends.

Is this the end of the hunt OR CAN I leave the stand there until the start of bow Season for deer several months later?

Is the stand abandoned property between Spring Bear and fall deer season and can be removed.

Gilroy, I have to agree with you on that. But I think many hunters will pass on a stand if they don't think it's be used at the time. At least that has been my experience. I have never had someone take my stand during the period of the first week of shotgun (another area I use to hunt for 15 years) but once I went out in the middle of the second week and found someone in my stand. I didn't bother them but ran into them later, they didn't know me but knew I hunted from it the first week and said so. They didn't expect me out the second week as I never had before in that area. I like to think most hunters will respect others if they realize someone is actively there.

Since my stands are permanent (Yes CO's have even seen them) I do have to keep in mind that someone might take them, but everyone I have met seem to be very respectable (maybe I am just lucky)

Prior to 2017, the MNR had a “Free Use Policy” and the 21 day rule was contained within it. That policy was replaced with Regulation 161/17. The “21 day rule” still exists but applies to Crown land camping. Here’s a link to the Reg in case your interested. https://www.ontario.ca/laws/regulation/170161

The reg allows the stand to remain as long as it’s required for hunting. An argument could be made that it should be removed between seasons since it is no longer required for hunting then. Because the reg isn’t crystal clear in this regard, it will be up to the courts to come up with “case law”.

could be a hunter seriously hurting themselves in a fall from a tree stand and a civil litigation lawyer making an argument that the Crown had a duty of care to inspect/remove/police stands left on Crown land.

But I imagine like every where else the Crown exempts itself from such prosecutions.

I hunted Moose with a Game Warden for years and built dozen of stands with him.
He basically said the same thing you just did.

Years ago I was hunting a 150 acre private farm out by Dunnville and before turkey season I set up a pop up blind and cleared shooting lanes and camo'd it up nicely. I knew there was another guy that hunted this farm as well and the deal was if you saw a car parked in the field laneway keep driving. I had 3 other farms in the area so I had options. After each hunt I turned the chair upside down and left a window open to get in and out of it. One morning I get to the blind and the window was closed and the chair was upright. After my hunt I left the blind the way I like it chair upside down and window open. 4 days later I am walking past the stand and the window is closed!! I was angry so I walked over and the chair was upright and has a note on it from another hunter thanking me for the use of the blind as he was hunting with his young son and was a friend of the landowner. My initial response was to leave him a scathing note but after calming down I left him a note and said glad to hear you are getting the boy out hunting........told him where I saw the birds roosting and their schedule from what I have seen.

This went back and forth the entire season and I even mapped out my other blinds for him to try. At the end of the season I go by the farmers house and drop off a bottle of wine and some flowers for his wife and she sends me to the barn to see her husband and when I get there he introduces me to his younger brother (the other hunter). We had a good laugh and fast forward 10 years - the brother does not hunt turkey anymore (busy with work and family) and has his own hog farm down the road and I also have permission to hunt there as well.

I know that this is NOT the same as crown land but diplomacy is an artform.......I figure these situation will become more common as land in S Ontario gets more scarce and more people want to try hunting.

I was thinking the same thing - risk of litigation! I have seen some pretty rickety looking stands while out on crown land and would not chance climbing many of them. Even the stands on the farms we hunt on are checked and inspected each year and the old/unsafe ones are cut down and replaced with new ones.

Wild…. Built stand or store bought? I have recently been leaving a couple stands out on public land year round. I’ve been pulling my steps every season though and don’t put them back in until just before. I’m also replacing straps every year. I wonder if they thought your stand was abandoned. Mine are pretty obviously in use. I’ve just recently started putting out ladder stands out on our private property. Talk about way easier to deal with than climbing steps.

This is how I roll. If someone is in my stand, I need to get there earlier. Good luck, heres my number, let me know how you made out. If someone is in my duck blind, same deal. I know not everyone is like me, but its about bulding a relationship, and not being an idiot more than anything.

If you want to pick apart the rules and regulations down to the dotted I's, your over thinking it and being an idiot.

I couldn't agree more Sinker :goodstuff:!

It's much harder to turn the other cheek than be aggressive as your first instinct is to kick the guy out, but it's a much better thing to do to take the high road in these situations. You make a lot more friends this way instead of enemies.

The other guy will be grateful, and is more likely to help you one day if you need help, like loading an animal on your truck or giving you a boost when your truck wont start.

The other thing to remember is that hunting is not something that is handed down generation after generation as much as it once did. I know lots of new hunters that have no family history of hunting and have just 'taken it up'. In doing so they are not only learning the technical aspect of hunting (playing wind, stand placement, times to hunt, bush skills) but they are also learning the social norms of hunters (what to do/not to do, what to say/not to say) and this can take some time and sometimes all it takes is some kind words and encouragement along the way to make a great difference.

Two local guys, lifelong friends and Hunters.... the greatest guys 51 weeks a year...but when it comes hunting absolutely a Dr. Jekyll Mr. Hyde scenario. They become complete a-holes with everyone. The neighborhood has hundreds of stories of their nasty antics thru the years. It got so bad they even divorced each other (1/2 owners of the camp) . Huge squabble over basically nothing. HaHa.

When it comes to hunting, a lot of guys lose their common sense :)

I have a fond memory of sharing someone else's stand just about 40 years ago.
It was my first solo bear hunt in northern Quebec and was green around the ears about it.

I was staying at a decommissioned DEW base with a friend who had purchased a home there for pennies on the dollar and used it for hunting activities. We hunted a few days for moose together then went our separate ways.

I did some scouting in the general area and found a spot with fresh bear activity. There was also a ground blind that was unoccupied at the time so settled in around 3 PM that afternoon. About an hour later, here comes an old Westphalia van down the bush trail. It stops near the stand, the driver eyeballs me and proceeds on to do a u-turn down the trail and bogs the van down in soft sand.

Revving the engine, spinning tires and trying to jack the vehicle out with no luck after 20 minutes I said to myself "Oh well" my hunt is over now so might as well go and help him. I had a 3/4 ton Chev 4x4 at the time with a heavy chain and made quick work of pulling him out.

I asked him if the stand was his and he acknowledged but said that since I was there first then he would move on to another spot.
He also indicated that he had been working at getting a large bear that had been visiting the area and wished me luck in getting it.
What a classy gentleman this guy was I was thinking to myself.

Without hesitation I invited him to his stand and struck a deal. If the large bear showed up he would take it and if a lesser one did then I would do the shooting. Turns out that this was one of my most memorable hunts ever.

Turns out that Karl was a retired Lufthansa 747 and earlier ex Luftwaffe Junker ju 87 pilot during WWII.
His passion was bear hunting and he did this worldwide. All the exotic places he hunted like Romania and Alaska just to name a few.
He was dressed in his Bavarian hunting gear and even placed a plaid wool blanket on his knees to keep warm. He brought out a couple of the small airline liquor bottles and we cheered a toast to good health together. We quietly chatted and I remember how mesmerized I became with his stories.

Sure enough, at dusk here comes a bear. Karl put up his drilling on it, paused for a moment, turned to me and said "not my bear".
That was my cue to take the shot with my 30-06 followed by a second as it ran down a ravine. It expired there and after roping it I pulled him up with the truck and we gutted and loaded him into the back of my 3/4 ton.

Turns out that Karl was also staying at the base in another home just down the street. He offered and helped skin it the following morning in which I had a taxidermist turn the rug and head mount into my first bear trophy.

Moral of the story is be nice with the people you encounter. You never know how it could become the best hunt of your life.

MikePal is right, most hunters are super nice and kind people that will go out of their way for you, but something happens at hunting time that turns them into monsters ready to destroy your tree stand with you in it LOL, and cut the tire valves off your truck LOL, in revenge for a small and temporary infraction by another hunter.

This fall if this happens to you, take a deep breath and think before you let Dr. Jekyll out.
