no, you are NOT breaking the law. If your equipment is encased, then you are not “hunting” according to the definition given for hunting. You are walking to a location of your choice in the dark, but you are not yet hunting. Once your equipment is uncased then and only then do you meet the legal definition of hunting.

The definition of huntng doesn't say anything about an encased firearm...but does include "lying in wait for, searching for, being on the trail of," all things we do when we are sitting in a stand or blind.
Add using an Estrus drag, hanging a wick on the way in, liting a scent stick before you go into your blind, sitting over a bait pile...all mean your hunting.

Rick...night is between the legal times...can't hunt at night....means you can't be in a Blind or stand if it's night (dark).
You have to sit in the parking lot talking to the COs until the legal time before you head into the bush. HaHa..

So, according to you, the 50 years worth of instruction we have been giving our hunter ed students in our classes is all wrong??
Your reading TOO much into the interpretation of what is meant by hunting. My sitting in my blind before daylight waiting for 1/2 hour before sunrise to come is NOT hunting if I dont have anything uncased. It is NO different than sitting in my car waiting for daylight! I cant be “lying in wait for” if I dont have anything uncased to shoot it with!!!
