You'll only get a ticket if you're riding down a road, otherwise it's fine. Technically, it's illegal to ride a two up ATV even if you don't have a passenger, but you'd likely have to piss someone off to get that ticket.

It's stupid but it's the way the reg is written.

I am pretty sure that a machine which is designed as a two seater, (one infront of another, not side by side) is OK. There is a list of which machines are exempt. I will try and find it again and post a link. OK I found what I was looking for. It is OK to ride two people on a machine that was designed for that purpose BUT Last5oh_302 is right. You cannot ride on any road even if you don't have a passenger, although it is legal to cross it directly.

The 2up factory built atv not being allowed on road is crazy. Can not see the reasoning for this at all.

Yes I forgot to mention this. That's new. You can now cross a road, but your passenger has to get off before crossing.

I believe it is because the current laws regarding highway use were written before the introduction of factory 2up machines, and the law has not been updated to include them.

An ATV being driven on pavement is very unstable unless the tires have been shaved. Most couldn't keep up to highway speeds anyway and would/could cause safety issues.
