Port Hope COVID discrimination

So a buddy of mine researched for hours whether he could go fishing in Port Hope.
The town lifted their restrictions on lands accessing the river, I believe May 12. He could not find anything on line
indicating the restrictions were extended, or new restrictions were put in place. He drove there, and even talk to some shop owners, and some people walking by the river ... they indicated that people are fishing on the river.

Then some guy in a car from the local newspaper tells him they can't fish, police are issuing tickets to people coming from outside of Port Hope ... locals can fish there, but anyone outside can't ... tickets issued for "violating" the stay at home order. They left after that.

But tell me ... these cops are issuing tickets to only people fishing that come from outside Port Hope, saying it's non essential.
So, fishing for the residents of Port Hope is essential, but if you're outside of Port Hope, it's not essential??? WTF???
Does Port Hope not realize that we have a PROVINCIAL fishing license that we all equally pay for, and the river is managed PROVINCIALLY ... not locally???

PORT HOPE DOES NOT OWN THE GANNY RIVER ... this is pure BS!! It is discrimination ... big time. I hope people bring them to court, heck I'd go class action on this and make sure they are put in their place!

The highlighted pretty much says it all. If you want to listen to some guy go ahead. There is no travel restriction in the sense that it is written you can not leave your health unit. If one was given a ticket most likely it wasn't for fishing or violating the stay at home order but for accessing areas closed to public or distancing/mask requirements.
Now if that peeved you take a look at whats happening in Ajax to restrict access to residents only and don't get me started on the innisville to keswick N.I.M.B.Y's

No, this is not correct.

Firstly, the cops were ticketing people that were out of town ... here's an article:

My buddy at first challenged what the reporter was saying, and then the reporter pointed to this article (although I admit those charges were laid at end April, when the access restrictions were still in place). Police were present (visually seen by my buddy) and the reporter indicated they were asking people fishing that day to identify where they resided. If they were out of town ... they were charged under the Emergency Order ... my buddy didn't stick around, but he knows the cops were there.

Also, in this article, why did the police feel the need to state ... we won't ask you where you live ... but Emergency Order. Why was that even mentioned? Is it because they are using the Emergency Order as an excuse to card people ... and keep outsiders off the Ganny?

If this is correct, it seems in the local police's interpretation (and certainly what the report was advocating), you should not travel to go fishing ... apparently that is non-essential. But if you're a local, it is okay ... go figure.

Perhaps the reason is Port Hope just doesn't like fishermen from outside Port Hope??

So, if these are both correct, what gives? You don't need to wear a mask while your fishing, so unless these guys were hugging each other ...

Here's another one. The video was taken yesterday ... my buddy actually is in the video (so we know for a fact it was yesterday). See the 3:25 time mark in the video ... you will see the cops approaching people close to the river (they were at least 6 ft apart, one person on the rock, one on the path, I know that exact point ... it's EASY 6ft, heck the rock itself is probably 8 ft wide) ... then they start talking to fishermen ... this was yesterday ... the fishermen were in the water, and not close to anyone ... go figure when you have a 14 ft rod that it's easy to maintain your social distancing space!

WHY were these fishermen stopped and questioned? What part of the law did they break?

On Saturday, 4 guys were charged, given tickets.
Yesterday, several anglers were cautioned and told to leave. My buddy was there.

If the cops want to come find me they can, if they do that means there is no reason for a Police force as I am 50+ km's from the nearest town and 20 km from the highway and requires a truck to get there.

i think part of the issue is that if you have travelled out of your area and something happens and you have to go to the hospital, etc. it may contribute to an already overwhelmed system (policing, paramedics, nurses, doctors, etc.). Nothing wrong with hunting/fishing just stay in your own area. I live in an area that has been "invaded" by people travelling from the south where the incidences of the pandemic are higher than where we are. We like your business but not until it's safe. Our small hospitals cannot handle an outbreak. Frustrating!!

Talk to Doug Ford.......what part of stay at home order does your friend not understand? Sounds pretty simple to me. The Province does not own my golf club or my gun club but I still cannot use them.

Maybe they should have a banner between the fishing rods stating Free Palestine or Pro Israel and maybe they would have some wiggle room - LOL

Although I agree with everything you intend and say. He has no recourse as they got him under the stay at home order. Unlike protesting which is protected Charter 2 activity, and, all charges will be thrown out eventually (but only if you choose trial and fight it), in this case he is toast, and must pay the fine.

It pains me to write that, but he will not win.

Protesting is protected Charter Section 2 activity. The Provincial Order does not supersede our Federally Protected rights. Since the Federal EMA is NOT enacted, then protesting is legal at the provincial levels. IF and when the Feds enact the EMA, then Section 1 of the Fed EMA can allow the Feds to override Section 2, at that point you can charge protestors, NOT under a Provincial order as is occurring now. All those charges will be thrown out if you were exercising in the Sec 2, of the Act exercising the 4 articles listed. You must record and have a record of your activity at the time of ticket. Record the police.

This is what is so wrong with our Charter - a right is not subject to law.

The order is an excuse, with some fairly liberal interpretations ...

If fishing is non-essential, then it should be non-essential for Port Hope residents as well! PERIOD. The law has to be black and white.
PORT HOPE should/must get clarification from the Province to name fishing as non-essential then! Otherwise this is blatant discrimination.

They have been handing out tickets all winter for people not staying within their region. Some guys were getting tickets for ice fishing Simcoe this winter coming from Windsor.

3 of us just sat on walleye heaven the past few days it was an amazing time and some quality time with my loved ones.

I will fight the ticket if I get one.

I don’t have a problem with municipalities deciding to Jack parking fees ( Barrie), close boat launches ( too many to name), fine out of region people. Whether that’s Port Hope, or Ajax.

As a country, we want our borders closed. Most or all provinces have closed borders. Why should or shouldn’t municipalities?

The EMA, gives the province sweeping powers. And if I’m not mistaken, Municipalities too. One of which is to limit/restrict movement.

Do I agree with it?
Doesn’t really matter. I can certainly understand why municipalities that get flooded, might close their boat launches/Jack parking fees, fine people that aren’t local.

I have a 3 hr drive to pick up my new boat in Kingston Sat...and 3 hr back.......haven't a care in the world about being ticketed....it'll go straight into the recycling bin......

Yeah, you are definitely "woke" and triggered too.

Whether you ignore a law is your decision but with that decision there come potential consequences. If you are issued a ticket for breaking the law you remain innocent of the charge unless you pay the ticket which is regarded as a plea of guilty. You have the option to challenge the charge in court at which point a decision will be rendered on whether you are guilty or not.

I was checked for fishing license twice by OPP on SImcoe this past winter. No mention of any ticket for being 'out of my area'.

All of the cases I heard about were from other violations fishing to close too many people together and speeding on the way home. Usually something lead up to being questioned.

Follow the rules in place and most were good.

You being an advocate of gun control and bad laws puts you square into that camp.

There are 15 former and current LEO's taking these orders to court.
That pretty well sums up how bad the law imposed on us really is.

I haven't been for crowds or been in bars for a few years after quitting drinking, so there wasn't much of a disruption on how I do things these days to how they were before.....fishing, hunting and family time are about the only things keeping me sane this last year and a half.....:)

Sorry, what law was broken?? You seem to think a law was broken by fishing in the Ganny. That is one BIG assumption.
The order allows for "exercise", it also does not prohibit being outside, it also does not prohibit travel.

Are you ASSUMING that fishing is not considered essential? OK then, if it is not considered essential, then WHY are the police in Port Hope allowing residents of Port Hope to fish? It either is essential or isn't to all.

This double standard does not have any place in the law ... it is wrong, and I hope the Town gets nailed for it.

The EMA, gives the province sweeping powers. And if I’m not mistaken, Municipalities too. One of which is to limit/restrict movement.

Doesn’t really matter. I can certainly understand why municipalities that get flooded, might close their boat launches/Jack parking fees, fine people that aren’t local.

I have one issue with it. IS fishing essential or not essential?
If it is not essential, then NO BODY should be able to fish Ganny, not even residents. How can it be okay for residents
to do a non-essential activity under the order? If so, I just broaden my definition of resident to all of Ontario, especially
given fishing and the waters is all managed at the provincial level.

What is occurring in Port Hope isn't about fishing it's about people from outside the area visiting the region in contravention of public health and/or emergency management legislation during a state of emergency. It doesn't matter whether they are fishing or not.

(1) oh right, that land is open right now ... anyone is free to walk the paths, cops are not ticketing or questioning anyone on the paths. River access was granted on May 7th.

For people who need to fish to feed themselves it is essential.

Fishing is classified as essential plain and simple no laws broken to fish. Doesn't matter if you need it as food who in Canada needs fish to eat because that is what they can afford. ?

The mnr even says fishing is good to go.

It's the moving around that's the issue. Under the stay at home order fishing is ok traveling great distance to fish is not ok .

Stay within reason and there is no issues.

It's as simple as asking for a license then add another ticket for breaking the travel rule's.


If they ask for a fishing license it give reason to ask where you are from. Just a loophole on their end.

I see laws broken every single day. Drive down my road the speed limit is 80 everyone does 90 - 100. I have many time been right behind the Police doing 95.

Point is we break laws every day especially if they are silly or stupid laws.

I will be out camping this weekend, I have a higher chance of dying from a heart attack (My family history shows that) then I do from Covid. I will take my chances but I am not going to stay in my house and potentially die of a heart attack not enjoying my life. My son will be with me and my best friend who lives these days as a hermit. I will be less likely to contact Covid then you going to the store.
