You'll only get a ticket if you're riding down a road, otherwise it's fine. Technically, it's illegal to ride a two up ATV even if you don't have a passenger, but you'd likely have to piss someone off to get that ticket.
It's stupid but it's the way the reg is written.
I am pretty sure that a machine which is designed as a two seater, (one infront of another, not side by side) is OK. There is a list of which machines are exempt. I will try and find it again and post a link. OK I found what I was looking for. It is OK to ride two people on a machine that was designed for that purpose BUT Last5oh_302 is right. You cannot ride on any road even if you don't have a passenger, although it is legal to cross it directly.
Here is a link to the sudbury area ATV law

i'll let the cop tell my wife to get off of the machine before we cross the road! Hope he's wearing a jock!

they were fining guys for crossing the hwy in bonfield last year on a poker run...the opp that is
An ATV being driven on pavement is very unstable unless the tires have been shaved. Most couldn't keep up to highway speeds anyway and would/could cause safety issues.
They aren't allowed to drive at highway speeds! That is why they have a reduced speed limit.
I have been told that there are probably going to be some changes in this law. Contact your MPP and tell them what and why this should happen....
I can drive with 200lb of dog food on the front rack and 400lb on the back, but I can't take my 60lb grandaughter on a trailride!
There is an MPP ( Conservative I believe), who is proposing an amendment to the current law to reflect the fact that 2 up machines are now being used with an increased regularity.
Of course the law still basically puts the Municipality in the drivers seat as to whether or not they want to allow ATVs on roadways or not.
I been wanting to get an atv so from what I coming to understand that you can not have a passenger on the atv on the trail even if it is made for 2 people? Am I understand this right?
Thanks for clearing that up. Right now I do have access to a neighbours atv to use when I want. Good to know this before I decide to use it.
Just make sure you bring the ownership and pink insurance slip with you....
Wonder why I can't use my Rhino the same as a quad? It has a roof, roll bar and seat belts.
Just because your ugly and short Woody . LOL j/k . It is upcoming but has yet to pass through the traffic act . Silly I know , and does not make sense but then again this is redtape government and bureaucracy . Its only on the road that your limited .. . Drive in the ditch or one side on the shoulder .
TD
Short!!!!!!!!!!!!!, I am not from North Bay, just under 6 ft., was just over for nearly 60 years, started to shrink around 5 years ago. Lol
Wish I could argue the ugly part,, but that is life. thanks guys
Because you "need to have a good conversation about it" with Kathleen Wynne, seems to be the way she operates.
As others have pointed out, the motion was passed by the MPPs, so the real question now is why isn't the Minister of Transportation implementing the changes that his elected peers have voted in agreement on.
FYI. You are not allowed to ride two people on an ATV on the Haliburton ATV trails.
From Haliburton ATV Association Home Page:
Declaration on "Two Up" Riding
ATV's may be ridden "two up" on designated trails and private lands but not on roadways (highways) as defined under HTA Regulation #316. HATVA will allow "two up" atv riders provided they are using the designated trails. ATV's are responsible for their own actions and risk in situations where they might ride two up on roadways (highways) in breach of HTA #316 included forest access roads deemed to be defined as highways because of availability of public access by cars or trucks even though these roads may be open legally to atv's as defined or stated under HTA#316.
Thanks KMan. It looks like the regulations have changed in the last year. I inquired a couple of years ago and was told no two up riding. There are lots of people riding around Minden and Haliburton two up, and I just figured that they haden't been caught yet. This revision changes things a lot for me.... for the better. Thanks again.
In the last 3-4 years I've ridden the Haliburton trails there has never been a ban on two ups or side by sides.
Side by sides are now considered dune buggies and dune buggies are now considered atv's....hence side by sides are now atv's. This passed in the spring. I carry the paperwork in my Teryx but will retrieve it and post the appropriate sections over the weekend. However, individual municipalities can still pass their own bylaws regarding them as can clubs.
I call Shenanigans!
if this were true, then why were side by side vehicles even mentioned in MPP Crack's motion? And why was it being set for debate on November 7 2013 if this was passed in the spring.
copy and pasted from legislative assembly of Ontario's website
" Ballot Item Number 55 – To be debated November 7, 2013.Private Members' Notice of Motion Number 48
Avis de motion numéro 48 émanant d'un député
Mr. Crack — That, in the opinion of this House, the operation of off-road vehicles on highways under Regulation 316/03 be changed to include side-by-side off-road vehicles, four seat side-by-side vehicles and two-up vehicles in order for them to be driven on highways under the same conditions as other off-road/all-terrain vehicles."
A 3 wheeler is OK but 4 is not....were almost there....
