anyone know anything about hunt camp building permits and septic tanks?

so basically im looking at a property to buy which has a hunt camp on it and septic system already put in. the only problem is the guy has no permits for the building on it or the septic. the hunt camp is a 2 storey and 640 sqft. just under the sqft for a legal hunt camp. it also met the other requirements too as far as i know. i called the township and they basically told me i would have to submit a new building plan for what already exists. and get the septic permit. he couldnt go into detail with my certain request as i would have to get permission from the actual owner for the township to go into detail with me about the specific property.

has anyone ever bought a property and is in this situation? if so any input would be great.

would it be worth the hassle?

Sounds like a can of worms? Present owner should have that all straightened out for any purchaser? He did things shady, and you'll be left on the hook to correct it all to standards. Walk away.

Sounds like the owner and the township guy may "know" each other. They enjoyed the camp, you'll pay for their play..

thats what im thinking too. maybe ill just low ball him see what happens. if i end up with it ill just get a permit to tear the place down and build a new one. then get a permit for the septic too ?

the only reason im leaning towards it is because we went up to go see it and from what i remember and the information thats given it looks like that cabin IS within legal standards from what i can tell anyways. ive been up all morning reading through the building regs.

does anyone know if you need an assumed road to your septic tank to get it sucked or does a trail big enough for a truck to get through qualify? this is one main thing i couldnt find if anyone has that info as well!?

Is it a holding tank or a septic bed ??? Will be looked at differently. I do believe most 'temp' housing is allowed a holding tank without a permit.

They don't "know" each other, it's standard procedure to maintain the privacy of property owners, including information about any structures (buildings, septic systems, etc.) on their property. If you're so concerned, file an FOI request for the property files including any previously issued building permits. Easy.

What is "legal sq footage for a hunt camp"?

Ive never heard of this. Hunt camps are not defined in the building code that Im aware of. My hunt camp is the same as any other seasonal dwelling

keep in mind different townships have different regulations.

I have been down your path before OP with properties. I can't say I have purchased exactly what your looking at. I can tell you that what ever buildings are on the property when new buyer purchases, it is there building or buildings to keep. Until you decide to do anything like build, you have no obligations as a new buyer to your township office about your property besides paying your taxes.
Many people purchase wood lots, bang up a cabin before the Township finds out and flip them to a new owner to have legally. Get a tax bill from the seller to show what the taxes are per year. At most they could tax you higher with septic, if they find out, but you still keep it. The integrity of the building should be your biggest concerned if it was done under the radar.

No, you purchase the property under the assumption, what there is legit. If at any time in the future the Township was to find out, you would just be taxed as any other land owner with a legit camp in your township.

How about access to the property OP? Road, trail?

off of a maintained year round road then onto the property its down a trail you can drive thru about 600 M into the bush

If the camp is old the permits probably do not exist anymore. My last house had no permits and my current house has no permit. It's not a big deal

I can show you about 100 house around my area that I will guarantee have no permits.

it is a older building. from what we could see from the outside it looked pretty well maintained. didnt get to take a look inside yet tho.

Not talking about "Privacy" of owner.

Both local guys, so bylaw guy looks other way when buddy builds cabin or puts in septic. Now new guy comes along, so bylaw guy goes for wallet.

I have seen that trick before.

Op you want to make sure you have legal right of way to and from property, If it's off a trail you want to make sure you have an easement if the trail is private land. That you can inquire through a township office as to property lines, easements etc. Your lawyer can also answer any thing that doesn't seem right.
One piece of advice don't give your township office any information about your property they don't already know about, that would just be foolish..

Is this an organized township? We have a camp in an unorganized township. We have done additions , there is no permits required , that I know about. We pay taxes to school bd, rd board.

yes its an organized twship. ive read the regs for the township as well. im not sure why he wouldnt get a permit before trying to sell the place.

It depends on the size of the property and what's around it to be worth the hassle. Is the property serviced? Does it border crown land? Is there water access to a lake or river? Before you buy anything,require certification for the water (well) and septic system and demand full disclosure,tax statements,liens,the usual stuff a lawyer is required to do with any sale. If any of it looks shady,either get it clarified in writing or,like Bushmoose said,walk away.

yeah, im gunna see if he entertains the lowball then ill get my lawyer to go through it.

it is off a year maintained road access to lake and river and abuts thousands of acres of crown land. the only issue is as i said the building issues. thats the only reason why im still even thinking about this place. ive been looking for land for years. the problems always been either to much money for garbage land. or land that is never maintained OR swamps and wetland crap for a heap of money that isnt justifiable in my eyes.

Abutting crown land with water access at a decent price makes that property worth GOLD,even without a cabin. Take a very close look and don't discount anything. Just be sure to do your due diligence. I know people that would give their left testicle for a chance like that. Say very little further to the municipality. Those "local" folks can bury you with bullshyte. Let your lawyer work it out.

hhahah why do you think i havent said what township ;)

Not having a Permit for your property is considered existing. Heck they cannot even find a permit for my electrical. It's EXISTING. My house was built in 1973 my previous hose was considered over 100 years, neighbor remembered it being installed when he was a kid about 50 years ago again no permits. In a rural setting or in thew booneys you will rarely have a permit unless it's new. But do get a lawyer at most probably 200 grand I think my last cost me 1500 in 2006.

Trimmer it really doesn't matter about the permit, I can tell you almost every house in my little community doesn't have a permit including the older farms, in fact I would go as far to say any house more than 50 years in Eastern Ontario doesn't have a permit for a septic at least in eastern Ontario where I live.

That is very specific, I have seen that sort of thing for a trailer as well, no increased taxes if not used for a certain about of time, sort of thing.

Septic is weird, if it was not already installed and you wanted to have an inside toilet I would tell you to go composing and then have a brown water system for your other drains.

Does this place have a well too?

I am not disagreeing with your figures Bowjob but my understanding by new MNRF rules is that as long as buildings are up too spec that square footage is not an issue.

checked on ontarios well records says there was one put in in 2009. 122M in depth.

Typically a septic can't be installed without a qualifying building, as you need to show occupancy, and calculations for waste water, set backs etc.

A well usually won't be drilled unless there is a record of same, as there are specific requirements under the Source Water Protection Act.

OP, if it's a decent deal, I'd go for it. The age of the building, and the subsequent work, would indicate that even if the structure was done without permit, it likely is grandfathered, as evidenced by the septic, and most recently the well.

Does the township have an interactive mapping site that shows the structure? If so, that's a very good indication that it is.

awesome info. i never thought of the grandfatherd scenario.

im gunna have to call the city again but they still wont give any info on the property without the owners permission. guess ill have to wait and see if he responds tho the low ball offer.

I don't understand what your talking about requirments for a well? I just drilled a well on a property with no septic. Simply call a well driller, pay and it's done.

If he's using a real estate agent or a lawyer they (he) has to answer those questions by law.

Theres never been a well on my property, the well was done simply by making a phone call. There is a welded stamp on the side of the well casing, I would assume what ever legal requirements was included in the price.

Isn't that for him to be 'permitted' to do the work in the township....but as a home owner, who wants a well drilled, you must in the bylaws, request a permit from the municipality and the work has to be inspected... at least that is what is on the books in my municipality.

as a land owner you need to have the permits to have the work done. its not the contractors problem to get the permits, thats what i researched as well.

Do as you please, all I can tell you is I now have a well whereas I didn't before, it cost me nothing more than phone call to a legit well driller from my area. My taxes have not increased the well has a stamped number and no permit on my part was required from my township office.
Septic system is a whole other issue that does need a permit and inspection by township.

What's a permit. :shades::)

Well drilling does not require a permit generally speaking. Usually all that is required is for the driller to file a well record with the province showing the construction details and showing that regulatory construction standards were met.

If the user intends to take more than 50,000 litres on any given day than a Permit to Take Water is required. This assumes that the well is not for domestic use. If you prove it 100% domestic and not municipally owned than you can actually take north of 300,000 litres per day ( can't remember the exact amount) sans permit

The permit taking requirements also apply to taking surface water and are an aggregate i.e. all water taking (surface and groundwater) combined on any given property must be less than the volume caps to avoid the requirement for a permit.

Whether there are structures or not, existing wells, whatever does not matter. If you have the cash there is generally nothing stopping you from dropping in 10 wells if you are so inclined

"A well wont be drilled unless there is a record of same".

Your well was drilled by a licensed well installer, and a record was filed in accordance with R.R.O. 1990 Reg. 903. These are filed with the province, however, recently many Municipalities have required the record to be filed with their building Dept. under the SWPA.

"16.3 (1) On completion of a well’s structural stage, the person constructing the well shall,

(a) complete, in accordance with the instructions on the form, a well record for the well;

(b) deliver a copy of the well record to the well purchaser and the owner of the land on which the well is situated within 14 days after the date on which the well’s structural stage is complete;

(d) retain a copy of the well record for two years. O. Reg. 372/07, s. 17."

Nothing was required on my part from my township, if it was the driller never mentioned it, drilled my well, paid him and he left. Actually my neighbor in town (just outside of town) just had a well drilled last year, just spoke to him last night about it. Same deal, called driller, came drilled capped it and left.

We are in the process now of extending our well, they are required to submit well records, they are required to do a pressure test, they are required to shock the well. You may be able to get a guy to drill a hole but a well hookup would not be something that would be done with cash and a call. If there is a well record on file then you can bet it was done legally, nobody would drill and file without covering their butt by doing what is required by law.

Actually it was always available even long before the SWPA. It was just a little more onerous to get. Through the Water Resources Act we used to collect data on anything there was a record for. This was in both private industry and municipally and for me was going back as far as the 80s.

Thats exactly what was done, I called he came he did what ever it is he does. It still does not change the fact I did absolutely nothing on my end except, call him,pay him, I have water. The driller is the most reputable in the area and is not a fly by night shyte type of business

well the listing say as is where is .

i basically offered him a little more than half of what hes asking for cuz if i go through the city im gunna have to spend the other half on all the legal crap building permits septic permit etc.

so im sure hes going to counter if he even gives the offer the time of day.

at that point ill start talking conditions if he wants more money for it. im not set in stone abut this property at this point for the amount he wants for it knowing all the city crap im going to have to deal with when it comes to that point but if i can get it for a decent price and then spend the remaining budget money on the city stuff im happy with that.

as fox said even if i need to tear down the cabin and start over ill be happy with it

for the right price.

You can have all the conditions you want that has nothing at all to do with the township. You can make conditions to be sure you don't end up with a money pit right off the start. You want to be able to go and enjoy the fruits of your labour, not fixing somebody else's pile of problems that take time and money to fix or work right.

thats why i low balled him once he comes with a counter ill throw some conditions in there if he comes back with a offer that is.

I think you're taking the right route by starting out with a lower offer (as long as it's not insulting) and letting the process work. You need to start somewhere. The worst that can happen is a refusal to accept or a full value sign-back. Either way,you'll know what your dealing with. Once you have a dialog going,then,you can ask hard questions.

yeah thats the plan. i wont even bother with it if he starts to push his listing price. not worth it at that point. it would be nice to have it . but at the same time i kinda want something closer anyways.

I doubt they even have the septic records anymore. I wouldn't worry about it nor would I bother looking for them.

yeah see the only problem is when i talked to the listing agent he said the owner is having problems with the city because of the permits

thats why i wont give him what hes asking for because if the city does decide to come after i buy it then at least i wont be out a bunch of money for buying the place then have to put more down to get the permits to build or demolish septic etc.

They are doing septic inspections now. Muskoka started already and I got a notice this year for my home. Every 5 years. Better if the township doesn’t even know you have a building.

Septic records go back a long way, our place was brought into another municipality through amalgamation, septic record is on file for 1995, well record for the same.

I myself have recently purchased a hunting property and considering options for building a camp etc.

What fox said...every septic and well must be registered if it was put in by a licensed contractor..if its not registered then he did it himself and was never inspected by the health department thus making it non conforming. The township will deem it as such and you will be liable as the owner(should you purchase the property). Hey, it might be fine but cutting through the red tape better make the property worth your while.

Hold on a second now,

As a homeowner I was able to apply for my own septic permit and install it to code. The Building inspector stopped by to give me a final OK before covering the bed and tank. My septic is registered and completely legal.

My Previous home which Just down the road 3 km's from my current home did not have a septic permit, was just marked as Unknown.
Life goes on. It is considered existing thus grandfathered. It was actually installed in the 1970's because my buddy who lives next door to it remembers it being installed.

Personally I wouldn't worry about it and I would just install a simple one myself as long as you don't have any rats nearby. Your other option is using a compost toilet and then just install a grey water tank and put the grey (Gravity) through a simple leach field.

septic tanks and weeping beds are inspected and regulated by the dept of health. they have the final say. New regulations issued by the province govern these factors. They passed this on to the municipalities a few years ago but are still regulated by the health department. If your septic bed was installed in the 70`s then its about due for an overhaul..the price will shock you. On the other hand, welcome to country living. If this fellow has given the township grief in the past then they will have their eye on this property and you as the purchaser will have to bend over to satisfy them. Its happened, i`ve seen it happen. Just dont bite off more than you are willing to chew.

I pump mine out every year and the tank is good to go and my bed seem to function as it's suppose to. As long as no solids get into the leach field should last for a hundred. If my did go there would be a backhoe here and a convert operation :).

one thing i learned when going through all of this stuff is go through your township regulations, im almost certain codes very from township to township and can get VERY confusing

Just ask the owner for a 'Compliance Letter' that way your covered for any/everything...from any back taxes/liens to outstanding permits
