Safe Storage

I'm curious how others interpret the word "remote", as contained within the F.A.

" Paragraphs (1)(b) and (c) do not apply to an individual who stores a non-restricted firearm in a location that is in a remote wilderness area that is not subject to any visible or otherwise reasonably ascertainable use incompatible with hunting"

There is no definition of the word that I could find in the act? In fact, I don't believe the word "wilderness" is defined either? Does this regulation mean 100 miles in the bush or a cabin 100 feet away from a road in a largely rural area surrounded by bush for several miles?

I think you're pretty much spot on Fox. A judge would have to make a decision, if it hasn't already been decided in a court case?

I’ve heard if you are paddling down a crick on your way to your favorite blind , and nature calls, and you pull your craft ashore and move a short distance away to relieve yourself. Your choices are to take your firearm with you or leave it in the craft. If you take it with you there is no problem, if you leave in your craft, I’ve heard it should be unload and disabled and possibly out of sight. It appears to come down to the idea of how a firearm should be safely left in an unattended vehicle. Not the fact that you might be in the middle of nowhere. To be on the safe side, you should probably take your trigger lock with you when you board your craft to go out duck hunting, you just never know.

The word reasonable was introduced in law with the Charter, and is the single most effective tool that allows police to charge and seize (WRT to Firearms) and force you into court to defend. It is a very vague and designed law word to do exactly that.

Whomever you heard that from was out-to-lunch. "Reasonable" under the circumstances may be used as defense should something like that ever happen,but,the chances are slim to none that it would ever happen in the first place.

I agree trimmer21, reasonable should count for something. I have an old Zulu shotgun that has an extra wide trigger guard so it make it almost impossible to close a trigger lock on it in order to disable it, so I was removing the firing pin to disable it for safe storage, I was advised by a firearm instructor, that was not one of the parameters the law describes as a means of disabling a firearm for legal storage. What do you think?

lol when i went for my saftey course,

the teacher was a retired cop,

he said your guns just need to be behind a locked door in your house and the ammo in another place.

also said you can legally have a gun in your back seat on the floor unloaded with no locks on it driving around? as long as its unloaded?

this didnt seem right to me always have my firearms locked in the truck


as long as the firearm is rendered inoperable that's safe storage i would think

Pretty interesting question and I have pondered it a few times.

A bunch of Toronto University students go up to Baffin Island to study snow geese each year.They have to get their PAL,s in order to use shotguns on site in case of Polar Bear problems.Their field office would IMHO qualify for a remote wilderness
situation.

A bunch of Moose hunters go up to Crown Land 100 klm north of Thunder Bay.They drive down a logging road for 35 klms and set up camp.Another camp is 5klms north of them and another 5klms south of them on the same road.

Camp in the middle leaves a shotgun behind in the tent while they go out hunt Moose.

They get home in the evening and the shotgun is stolen.They call the OPP and report it and relay on the remote wilderness defence,but its pointed out to them about the two neighbouring camps.

So I think you could rely on one scenario but perhaps not the other.

You really think the MNR writes rules vaguely so they can issue more tickets and charge people easier? That would be a pretty big ethical concern/conspiracy that law makers around the world would have to be in agreement on. The hunting regs in Michigan are vague too, so the DNR must want to punish people and waste their time and money as well?

Laws are left vague because every situation is different and the LEOs need to have wiggle room to weigh each situation accordingly and make an informed decision based on uniqueness of each case. Nobody would read the regs if there was a law for every single situation you could come across, the book would be 9000 pages long. Laws are written to be taken using common sense and for you to be able to grasp the "spirit of the law". Even judges don't all agree on how laws are supposed to be "read".

depends on restricted vs non restricted they both have different storage laws. You can legally have a non restricted in your vehicle as long as it is unloaded you could have ammo and a shot gun laying on the back seat. While its not illegal its probably irresponsible and inadvisable.

You can drive around with it in the seat beside you and the cartridges in your pocket if like. As long as it's between the hours of 1/2 hr before sunrise to 1/2 hour after sunset.

Draws unwanted attention in the wrong places, as you might expect, so use common sense of course.

No need to lock a non-restricted if you're transporting it.

If it's an antique Zulu built before 1898,it doesn't matter. Technically,it's not a firearm under the Firearms Act. Just to be clear,long guns of any vintage do not need a trigger lock as long as they're stored unloaded in a cabinet,closet or room which can't be easily broken in to. As for your Zulu,it's a beautiful wall gun hanging over a fire place. I'd love to see pics if you have any.

You can have any unrestricted in your car not locked and unloaded at any time of day. 1/2 hour before and after sunset is only for hunting. Otherwise you are just driving around and "transporting" firearms and can do so any time of day.

If you can drive there by car, truck, 4WD, or ATV it isn't remote. If you can drive to a boat launch and than get where you are going with out at least one or more significant portages it isn't remote. That's just my anecdotal take. To me 50km down a 4WD logging road is not remote it's just off the beaten path.

Remote implies a degree of difficulty that requires significant effort in order to achieve access. Doesn't even have to be that far as the crow flies just has to be sufficiently challenging. Riding on an ATV or driving a 4WD truck for hours on end is not difficult - just time consuming and is something a decent percentage of people are willing to do. If something is truly remote, in my mind 99.9% of people are not willing to do the work to get there.

I was making a general statement that law makers dont purposley make laws vague so they can ticket people and waste their time and money in court. One could argue that keeping the laws vague could lead to less ticketing as well. I just dont support the belief law makers put laws in place to be impunitive on purpose.

I know many cottages and camps that have an old shotgun, or .22 that when the owner is not there is stored in the back of a closet, under the mattress or in the rafters - ammo is stored in another location. I am sure that in the event of anything happening to them they would NOT be reported missing.........why would you report a missing shotgun worth $150 or a .22 worth $60. You are not going to recover it and are only opening yourself up to a world of pain my an over zealous cop.

Things like "Not easily broken in to" is there to be able to charge when they want to. Define this, can you easily break in to it if you only have a foot? Or is easily broken in to include any tools? I was told once the criminal needs a tool that it is not easily broken in to but the definition is up to the person with the cuffs, that is all that is needed. Once they take your guns and arrest you then the onus is on you to get your stuff back and clear your name, innocent until proven guilty is a myth.

Like when they kept a man from going in to his house to get the life saving drugs for his kid until he signed off that they could enter his house to search and take all of his guns that were legally stored based on the definition that is put forward by the RCMP.

There is a difference between storage and transport, that instructor was telling you that your gun was being transported safely and stored legally but if you put a gun on the floor of your car and go in for the night that gun would not be defined as legally stored, especially if there was ammunition in the vehicle.

You can keep your ammo right beside your gun, if they are in a locked room, that is spelled out in the RCMP storage documentation.

I would suspect it is the fact that safe storage regs were drawn up by the federal government and the MNR is provincial. I don't believe the MNR had any input in their creation, although they can enforce them.

COs dont normally enforce the FA. Up until this past year, when the FWCA was amended to include your firearms licence as proof of accreditation, to use a gun, they didn’t have any interest in seeing your firearms licence. Now, not carrying your licence is a provincial offence under the FWCA.
The Criminal Code and Firearms Act are just a couple federal statutes that is normally not their purview.
Actually, unless things have changed, COs are not “Peace Officers” as defined under the CC.

Did anybody ever claim that shotgun that was found on the 401 last year? It looked like it was worth more than $150

All posts were generalizations........we all know that someone that has 'X' stashed here. I am not saying it is me but I'm just sayin. I know retired cops........yes, real cops not mall cops. I would not say their pension cheque is anywhere close to fat. Sorry.

I can agree with those points. A former well respected teacher of mine was charged with careless storage and lost his entire collection, hundreds of thousands if not more in rare prohibited and vintage collectors firearms. This guy was extremely careful and was a pillar of safety being a machine shop teacher. I know him and I know the type of person he is and if anyone could steal his guns it would be nothing short of a miracle. Well it happened and he lost everything and now has to fight to get it back, so I can agree with it being impunitive in that respect however I do not believe its intentional. I believe they have to set a standard and draw a line in the sand somewhere and unfortunately it can be perceived as unfair as in this mans case. You can have the best safe in the world and bury it in concrete but if someone can get your guns you get charged, this I do not agree with.

Heres another scenario just for fun, somewhat related somewhat not and just something to read and think about:

My grandmothers partner has a lifetime ban on owning firearms from previous convictions. Hes got dementia and started an argument which turned almost violent and kicked my poor grandma out on the street. The local police got involved and it was discovered that he was in possession of multiple firearms a 14ga and .22 and they were not locked up and very carelessly stored in a garage filled with junk anyone could have broke in and got access to the guns. The police called my brother as my grandma informed him he is a legal gun owner and the police simply gave him the guns. No report filed, no charges, nothing at all! So even a lifetime ban on firearms and local PD doesn't even give a rats arse. Was it too much ppwk for them? WHY was this man not charged and how does local PD have authority to give his illegal guns away with zero record of the incidence. Compare that to the other example and it makes your head spin. So yea vague laws and the enforcement of vague laws can be disappointing.

So it just goes to show how different scenarios play out and each LEO can handle situations vastly different. Yes I agree there are some perceived fairness issues but my point was that I do not believe lawmakers (not enforcers) make laws to be impunitive on purpose, however I will agree they can be impunitive given differing circumstances.

Meter reader........come on Scooter, you can do better than that. But I do have a very profitable business partnership with people that do electrical work should you need anything. We even give senior discounts for those on a fixed income and all.

I am not sure where you have been in the last 10 years but Burlington Hydro does not use meter readers anymore. You see the new meters that the previous Wynne Gov't pushed through communicate automatically via RF or cell rendering the 'meter readers' obsolete. The only utility that still require a meter read now is water, and I cannot believe they have not figured something out by now.

I can definitely help you on the hydro poles - one of the guys in our group has a bucket truck but they are not cheap. We wired a trailer park in Southhampton 2 years ago - ran 12 poles and added electricity to 30 trailer sites.
Depending on the ground conditions you are looking at anywhere between $1,500 and $2,000 per pole supply & install. HydroOne only services the first 30M so there will be an isolation switch located here and the run to your cabin is on your dime - cable, pole, pole hardware, and transformer (which will be located on the pole closest to the service entrance into the cabin). All in you are looking at anywhere around $60,000

To be honest I would look at a solar option - $20k - $30k depending on your capacity requirement as Hydro rates up north are heading up as they are removing the seasonal rates on many cottages and most people will see a 30% rate increase. As PV systems become more popular it is driving the cost down and efficiency up (Swanson's Law - Google it I did not make it up). You will not re-coup the cost of installing electricity in a hunt camp or even a lakeside cottage when it is time to sell it unless you can share the cost with a neighbour.

I already know the hydro hook up costs and have decided that it would not be worth it unless I wanted to develop that land and split it into lots.The solar option I have ruled out as I do not know anyone who has set up a system to run a stove and power all appliances,the battery storage is another problem.

I believe just getting hydro supplied to the cabin is about $50.00 a month without even using any power.So for about $260.00 in propane and about $100.00 in gas I can run a genny and keep the camp for about 7 months.

My closest neighbour has hydro so unless I sell lots I would not have a person to share the cost with.

Yup..had to replace a pole to put in a 100 amp service $2350.....then with buried cable from pole, to a panel with proper CSA/Inspector approved Switch and CCT Boxes etc...total job cost me $8,200.

Definitely would look into alternative pwr sources if I was to do it again.
