Police surprised by new powers they have to stop anyone they see for no reason????

So I hear on the news that all police services in Ontario were blind-sided by their new found ability to start carding everyone they see on the streets again. Many forces are on record already stating they will not take advantage of these new powers they have been gifted with, but time will tell.
I do not see this turn of events going very well for the very small minority of LEOs that might go overboard on a power trip, and no one can say with a straight face that those officers do not exist in our province unless they live under a rock with no internet or social interaction.

I had a problem in my teenage years of being stopped by police and arbitrarily searched, I went to the ole man for advice. He said, " Tell them you are on and about your own legal business, give them your name and address when they ask then ask them why they stopped you. You are under no obligation to provide any other details."

Some people in authority, especially LEOs will say if you have nothing to hide then it is alright to answer their questions.
The police have the legal right to lie to you in order to have you incriminate your self, even unknowingly.
If the police pull you over, it is rarely to give you a gift certificate to Timmies, or extra ammo for the camp if it is a calibre you need.
Do not think I am a criminal or have a hate-on for law enforcement as almost all except one interaction many years ago have been kinda positive, even when receiving fines that I deserved.
I am just a huge proponent of asserting my rights and freedoms as an individual, a citizen of a still strong and free country, and try my darndest to keep my private life as private as possible in this day and age.

That statement is not part of our Charter. You've mistaken that for American "Miranda" rights,but,we get your point. All Canadians are required to do is give name,address and date of birth when requested. After that,keep quiet. Take your ticket and plan on attending court. That's where you argue your case,not with the cop at the side of the road.

They ask for license and insurance, I provide it. I also have a dash cam that turns 360 and records all interactions with police. When they are made aware they are being recorded, it evens out the playing field. It very surprising the change of attitude when they see the camera on them...lol.

Down here you don't have to identify yourself to a cop unless you have committed a crime - being stopped for no reason smells like the Nazi Germany - if you are driving and have been pulled over because of a traffic violation you must show him your driver's license, registration and proof of insurance - that's it - the question I have is who gave cops this right to identify you guys -

Don’t even have to do that, unless you are committing or being investigated for committing an offence. Driving is a different requirement to identify, licence ownership and proof of insurance, as I’m sure everyone is aware. The “carding” issue pretty much eliminated that requirement to identify when arbitrarily stopped...

Saw on the news that a lot of the Police Forces across Ont have written letters (again) stating they will NOT be doing random stops and asking if your trip is essential.

The OPP was a little more vague..they want to see the Health orders before the make a statement.

Not at all. Been the subject of late night harassment driving home from work at 2am. The reason I have a dash cam. Since being stopped twice and using dash cam both times, the harassing behavior stopped immediately.

As someone else stated police will lie to get what they want, been subjected to it. That was before recording interactions, since then they have stopped.

My father didn't raise me to lay down like a sheep and allow myself to be walked on by those that choose to prey on the weak. I know my rights and not afraid to exercise them when needed.

But when the police try to be proactive, they are loathed. So I suppose if someone stole your vehicle from your workplace, at 02:00, you wouldn't be upset that a cop didn't stop them to check on things?

Is not being proactive when police use lies to pull people over. Maybe you don't mind when a police accuse you of driving through a red light or stop sign as a reason for the stop. When they find out the dash cam is recording they become very agitated realizing they have just been caught lying.

Some may call it proactive, but the law considers it harassment and slander with a recorded video as proof.

If my car was stolen it would be reported until then there is no right to pull somebody over for simply driving down the road obeying the speed limits and road rules.

In the OPP there is a huge range or personalities and attitudes, some will warn and some will just ticket even if they know it won't stand to make you go to court and waste a day. Long story I will skip it but even 30 years ago I remember the head of the local OPP detachment talking about some of the new officers didn't need the upcoming training, he always made sure that a "goose stepper" was transferred somewhere else. His comment was that they were useless for a small community detachment, well they ended up somewhere and I know I ran into one last year for sure *. Arbitrary stopping, arbitrary ticketing essentially (does your excuse qualify), more and more like a Solzhenitsyn sound to it.


* Ticketed for not fully stopping the motion of my "vehicle" while out bike riding when I put on the brakes, put down one foot and "didn't fully stop the motion of my vehicle". He was in my face (with no mask), an attitude that fully qualified as "goose stepper", evident when I asked how much more stopped I had to be, my foot was on the ground and brakes on, court date is still TBD.

Police on Guard for Thee

We have received many questions regarding the new restrictions in Ontario.
As we have stated before, the Emergency Management Civil Protection Act and Reopening Ontario Act do not supersede the Charter as stated in 7.0.2 of the EMCPA.
Police have no authority to arbitrarily detain and question anyone for the sole purpose of a public health measure investigation.
To this point we have seen various responses from different services and associations (Reference the photos). The law is the law. Why the different responses? Because it's not about the law it's political.
Just yesterday Toronto police tweeted about the collection of identifying information in certain circumstances (CIICC) Ontario Regulation 58/16 prohibiting the collection of information when there is no authority to do so.
Hours later the provincial government announced new police powers. These powers are unconstitutional.
The measures under the ROA and stay at home order are also Ontario Regulations. Same type of legislation, yet contradictory. One says police can't stop an individual while the other says they can.
That being said if you are operating a motor vehicle and stopped by police you are required to identify yourself under the Highway Traffic Act. You are not required to answer any questions regarding the reason for being outside your home.

Unless the car is reported stolen it doesn't matter, why would they look for a stolen vehicle if it's not reported stolen yet lol?

Sorry no excuse to pull you over to see if you are in a stolen vehicle to funny.

However I have been pulled over for being a male registered to a female driver. Cop got pissy with me when I question him if that was even a reason.

I've been out and will be again if I get a ticket for something stupid i won't pay anything. It can sit and collect interest as I won't have any interest in paying it.

However, if there are reasonable grounds to pull someone over (busted tail light or rolling through a stop sign) they can stop you, but (as outlined in this case) should only question you regarding the offence suspected. A cop can't pull you over and ask to look in your trunk if you rolled through a stop sign - they would need additional reasonable grounds to do something like that.

Regardless, we should be thankful we have decent Case Law and the Charter to shut down oppressive laws that impact our freedoms. The government can use Section 33 of the Charter, the "notwithstanding" clause to allow some Laws to breach the charter, but these are subject to review in Parliament, and are very serious. They could use it for a Pandemic, but again, it would be front and center news and every legal beagle in Canada would be watching carefully.

Routine traffic stops are completely legal in Ontario, to check drivers for licences, insurance and/or sobriety. The court has upheld them as the need for public safety on our highways, outweigh any charter breaches caused by routine stops.

The problem is, they have given a police officer the discretion to decide whether what you are doing is or is not sufficient reason to leave your home ... you are breaking no laws going outside for a walk, going to check on another property, or going fishing ... but a cop gets to decide whether that is a good enough reason to be outside??? That is so wrong it's not funny, and the police know it, hence the numerous forces indicating publicly they will not enforce the new rule.

However, there were some cops out in Hamilton yesterday asking people in a plaza (where there is a Fortinos) what they were doing out of their homes ... so not all of them are supporting the departments standing on the matter ... so basically it's one big mess.

I was a witness at an accident and a cop showed up at my house and knocked on my door. I answered the door and we started talking about the accident and he asked if he could come in and I said no, I will come out to discuss. I put a jacket on and went out to my porch and had the conversation with him.

He asked me why I did not want him in my house and all I said was the less you know about me the better. No different if a cop asked to look in my truck - I would say no way.

I saw his interview yesterday, indicating there is no evidence that the previous Quebec checkpoints did anything to reduce COVID. I do believe (almost certain) that the government is just shooting from the hip with all these restrictions ... just applying the philosophy of STOP EVERYTHING except breathing in your own home. They are wrong to keep people cooped up in their houses ... they should encourage people to be outside walking, exercising, hiking, fishing, etc. Transmission has the lowest possibility outside. LOWEST ... so encourage outdoor activities!

I'm not sure I'd put all the blame on corruption. I think part of this is that Ford and his people are in fear of being criticized by everyone, and so they just take what they think is the "safest" approach to all this stuff. The problem is, the safest approach will have us all go bankrupt and most people living with depression ... they are simply dealing with what is immediately in front of them (COVID) and guessing how to deal with it (stop all outdoor activities ... total guess) ... and in the end they are ticking off a lot of people who have a bit of common sense and know it's madness.

Agreed ... but I have to say, I do have a growing admiration for the fact that the PC government at least is honest they have made mistakes, and are willing to quickly reverse decisions, which shows they are listening to the people. That is SOOOOO much better than the Liberals that will lie, lie, lie, deflect, deflect, deflect and allow stupidity to perpetuate indefinitely, or at least until the get caught red handed (and then still lie and deflect).

Agreed. The Feds are as much to blame, but Ford has to bend on other stuff. Listen to the doctors. When a whole panel of them say things like golf, camping with your own family and that paid sick days would help people properly isolate instead of going to work sick, I would listen. This is not just one doctor, its many of them who are the best in all of Canada.

That was a smart move - a lawyer will tell you not to leave a cop come into your house - he may accidentally see something that he thinks is unlawful and charge you - it is unfortunate but that is the way it is -
